SUMMARY

Synopsis of Bill

Senate Bill 432 provides that there shall be four magistrate divisions in the San Juan magistrate district (one for each judge) operating as two separate courts in Farmington and Aztec. The bill states that magistrates in this district shall not be elected at large from the district, but from the division for which the magistrate sits. San Juan magistrates will have district-wide jurisdiction.

Significant Issues

The bill provides for the composition of the four magistrate divisions by precinct:

•Division 1 is composed of San Juan County precinct numbers 46, 60-74, 78, 79, and 82;

•Division 2 is composed of San Juan County precinct numbers 2-4, 8-15, 17, 18, 28-31;

•Division 3 is composed of San Juan County precinct numbers 20-27, 41-45, 51, 52, and 54; and

•Division 4 is composed of San Juan County precinct numbers 1, 5, 5A, 6, 7, 16, 19, 53, 55-58, 75-77, 80, 81, and 83.

FISCAL IMPLICATIONS

There is no appropriation or fiscal impact associated with this bill.

CONFLICT/DUPLICATION/COMPANIONSHIP/RELATIONSHIP

Senate Bill 432 conflicts with Senate Bill 397. Both bills provide for the four districts in San Juan County; however, each district is composed of different precinct numbers.
