Synopsis of Bill
Senate Bill 184 would amend Section 74-4-3.1 NMSA 1978 to exempt the Waste Isolation Pilot Project (WIPP) or any other treatment, storage or disposal of mixed wastes certified by the US Environmental Protection Agency from the Hazardous Waste Act.
Significant Issues
Senate Bill 184 would preclude New Mexico from conducting regulatory oversight of WIPP or any other facility that generates, stores or disposes of wastes consisting of any mixture of hazardous wastes and radioactive materials.
Federal authorization by EPA requires New Mexico's Hazardous Waste Act to be at least as stringent as the requirements of the federal Resource Conservation and Recovery Act (RCRA). Senate Bill 184 could potentially jeopardize federal authorization.
