The Senate Judiciary Committee amendment adjusts the fee range from $20.00 to $50.00 to $15.00 to $30.00.
Synopsis of Bill
Senate Bill 107 authorizes counties to create Misdemeanor Compliance Programs to monitor defendants' compliance with the conditions of probation imposed by district or magistrate courts. The as drafted before amendment bill allows counties to impose a fee on probationers of between $20.00 and $50.00 monthly to operate the program. Counties have the option to create a program or not and may scale such a program to match the probationer income.
Significant Issues
A pilot Adult Misdemeanor Compliance Program has been operating in the Farmington Magistrate Court for approximately two years.
FISCAL IMPLICATIONS
Prior to amendment, Senate Bill 107 authorizes counties to impose fees of $20.00 to $50.00 monthly to persons on probation.
ADMINISTRATIVE IMPLICATIONS
Senate Bill 107 requires the Administrative Office of the Courts to formulate guidelines by which county misdemeanor compliance programs must be established.
