Synopsis of House Education Committee

The amendment adopted by the House Education Committee accomplishes three major enhancements which are consistent with the intent of the memorial:

clarifies the reasons for the memorial by stressing the health and safety aspects as they relate to the use of toxic pesticides while pointing out that "some" not all pesticides have adverse health effects,

requests that the State Board of Education in consultation with the Department of Environment and the Department of Agriculture adopt rules that eliminate the routine spraying of pesticides in New Mexico schools, and

requests that the rules adopted include to "prohibit on the use of pesticides when children and school staff are present."

Synopsis of Bill

House Joint Memorial requests that the SBE adopt rules relating to the use of pesticides in public schools.

Significant Issues

The memorial requests that the SBE adopt rules that require:

Elimination of the routine calendar year spraying of pesticides in public schools,
Notification of students, parents, guardians and school employees when pesticides are used,
Licensed applicators be used when pesticides are applied in schools, and
Records be kept of pesticide use be kept at each school.

FISCAL IMPLICATIONS

None at the state level.

ADMINISTRATIVE IMPLICATIONS

Public school personnel will have to keep the any records and provide any notifications required by the rules adopted by the SBE.
