Synopsis of House Appropriations and Finance Committee Amendments
The House Appropriations and Finance Committee amendment strikes the HENRC amendment (rescinding the fee comparability clause) and strikes the creation of Liquid Waste Fund and the appropriation clause.
Synopsis of House Environment and Natural Resources Committee Amendment
The House Environment and Natural Resources Committee amendment provides that fees adopted by the Environmental Improvement Board shall not be greater than the average charged by states contiguous to New Mexico for similar permits and services.
Synopsis of Original Bill
House Bill 478 gives the Department of Environment the authority to collect on-site liquid waste system fees and creates the Liquid Waste Fund into which the fees will be deposited. The Environmental Improvement Board would have the authority to set the fees.
Significant Issues
House Bill 478 creates a new nonreverting fund, the Liquid Waste Fund.
FISCAL IMPLICATIONS
The generation of liquid waste fees for appropriation to the Department could potentially result in general fund dollars becoming available for the management of the liquid waste program. The fee-based revenue stream cannot be estimated until the Environmental Improvement Board sets the fees.
ADMINISTRATIVE IMPLICATIONS
The generation of liquid waste fees could also allow the Department to devote more resources to the process of inspecting and permitting on-site liquid waste systems.
