SENATE FLOOR AMENDMENT number _______ to SENATE BILL 301, as amended

Amendment sponsored by Senator L. Skip Vernon

1. Strike Senate Judiciary Committee Amendment 19.

2. On page 9, after line 25 insert the following subsection:

N. In addition to any other fine, fee or sentence that may be imposed pursuant to a fourth or subsequent conviction pursuant to this section, if an offender is found guilty of a fourth or subsequent offense committed after July 1, 2000, a court shall increase the offender's sentence as follows:

(1) for a second felony conviction pursuant to this section that occurs after July 1, 2000, the sentence shall be increased by one year, and the additional sentence shall not be suspended or deferred;

(2) for a third felony conviction pursuant to this section that occurs after July 1, 2000, the sentence shall be increased by four years, and the additional sentence shall not be suspended or deferred; and

(3) for a fourth or subsequent felony conviction pursuant to this section that occurs after July 1, 2000, the sentence shall be increased by eight years, and the additional sentence shall not be suspended or deferred.".

3. Reletter the succeeding subsection accordingly.
