AN ACT

RELATING TO CORRECTIONS; PROHIBITING THE STATE FROM ENTERING INTO A CONTRACT FOR CORRECTIONAL SERVICES PROVIDED BY A PRIVATE VENDOR; ENACTING A NEW SECTION OF THE NMSA 1978.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. CONTRACT FOR CORRECTIONAL SERVICES PROHIBITED--EXCEPTIONS.--

A. The state shall not enter into a new contract with a private vendor for:

(1) the incarceration of inmates in the custody of the corrections department; or

(2) the provision of services related to the operation of a correctional facility.

B. Notwithstanding the provisions of Subsection A of this section, the state may contract for ancillary services, including:

(1) medical services;

(2) educational services;

(3) repair and maintenance services; or

(4) other services not directly related to the ownership or operation of a correctional facility.

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2000.
