SENATE FLOOR AMENDMENT number _______ to SENATE EDUCATION COMMITTEE SUBSTITUTE FOR SENATE BILL 151



Amendment sponsored by Senator Leonard Tsosie





1. On page 3, strike lines 10 through 25 and on page 4, strike lines 1 through 8 and insert the following:



"D. If, after January 1, 2000, a constitutional amendment has been adopted or legislation has been enacted that provides additional or supplemental revenue sources for public school capital outlay funding, then, in all subsequent application and allocation cycles, the following provisions apply:



(1) the funds shall be divided into two accounts:



(a) one account shall be distributed based on capacity needs of a school district; and



(b) the second account shall be distributed based on the condition and suitability of the school district's facilities;



(2) school districts may submit project proposals to compete for funding from either or both accounts;



(3) all school districts are eligible to apply for funding from the fund regardless of the school district's percentage of indebtedness;

(4) priorities for funding shall be established by the council for each account based on the following factors:



(a) the school district has a low assessed valuation per membership;



(b) the school district has little remaining bonding capacity;



(c) the school district has critical health and safety problems that need addressing;



(d) the percentage of unhoused students based on calculating the capacity by allowing one hundred square feet per elementary student, one hundred twenty-five square feet per middle school student and one hundred fifty square feet per high school student and the number of years that the capacity has remained unmet;



(e) the project has already been approved and partially funded;



(f) the condition and suitability of facilities in the local school district and whether a comparison of replacement costs versus new construction supports the proposal;



(g) the proposal is a local school district priority; and



(h) the proposal for a new project is based on a demonstrated need;



(5) no more than ten percent of available funds in either account shall be designated for technology projects;".
