SENATE BILL 141



has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:



1. On page 1, lines 12 and 13, strike "APPROPRIATIONS; DECLARING AN EMERGENCY" and insert in lieu thereof "AN APPROPRIATION".



2. On page 2, line 22, strike "that are approved by the department".



3. On page 3, line 9, after "of" insert "child-centered and developmentally appropriate".



4. On page 3, between lines 12 and 13, insert the following new subsections:



"B. The department of education shall require schools with full-day kindergarten programs to conduct age-appropriate assessments to determine the placement of students at instructional levels and the effectiveness of child-centered, developmentally appropriate kindergarten.



C. The department of education shall monitor full-day kindergarten programs and ensure that they serve the children most in need based upon indicators in the at-risk factor. If the department of education determines that a program is not meeting the benchmarks necessary to ensure the progress of students in the program, the department of education shall notify the school districts that failure to meet the benchmarks shall result in the cessation of funding for the following school year. The department of education shall compile the program results submitted by the school districts and make an annual report to the legislative education study committee and the legislature.".



5. On page 3, line 13, strike "B." and insert in lieu thereof "D.".



6. On page 3, line 14, strike "two-year" and insert in lieu thereof "five-year", and after "follows" insert "with priority given to those districts that serve children in schools with the highest proportion of students most in need based upon indicators in the at-risk factor".



7. On page 3, strike lines 15 through 19 and insert in lieu thereof:



"(1) effective with the 2000-2001 school year, one-fifth of New Mexico's kindergarten classes may be full day;



(2) effective with the 2001-2002 school year, two-fifths of New Mexico's kindergarten classes may be full day;



(3) effective with the 2002-2003 school year, three-fifths of New Mexico's kindergarten classes may be full day;



(4) effective with the 2003-2004 school year, four-fifths of New Mexico's kindergarten classes may be full day; and



(5) effective with the 2004-2005 school year, all of New Mexico's kindergarten classes may be full day.".



8. On page 3, line 20, strike "C." and insert in lieu thereof "E.".



9. On page 3, lines 22 through 25, strike "Only school districts operating full-day kindergarten programs approved by the department of education shall receive funding for full-day programs pursuant to Section 22-8-19 NMSA 1978.".



10. On page 4, line 2, strike "give preference to school districts with" and insert in lieu thereof "ensure that full-day kindergarten programs are first implemented in".



11. On page 4, line 6, strike "APPROPRIATIONS" and insert in lieu thereof "TEMPORARY PROVISION--FULL-DAY KINDERGARTEN--ASSESSMENT OF NUMBER OF CLASSROOMS".



12. On page 4, strike lines 7 through 16 and insert in lieu thereof the following new subsections:



"A. The state department of public education shall conduct an assessment of the number of classrooms that will be needed to fully implement full-day kindergarten. This assessment shall take into account projected student enrollment with consideration to school districts with declining student enrollment patterns.



B. The state department of public education shall report the finding from the assessment to the legislative education study committee by November 2000.".



13. On page 4, lines 17 and 18, strike "B. Thirteen million six hundred seventy-five thousand dollars ($13,675,000)" and insert in lieu thereof:



"Section 5. APPROPRIATION.--Six million five hundred thousand dollars ($6,500,000)".



14. On page 5, strike lines 1 and 2.
