Your APPROPRIATIONS AND FINANCE COMMITTEE, to whom has been referred

SENATE BILL 48, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 1, line 11, after the semicolon insert "PROVIDING FOR A RESERVE WITHIN THE GENERAL FUND;".

2. On page 1, line 20, strike "FUND" and insert in lieu thereof "RESERVE".

3. On page 1, line 22, strike "fund" and insert in lieu thereof "reserve".

4. On page 1, line 23, strike "in the state treasury. The fund" and insert in lieu thereof "within the general fund. The reserve".

5. On page 2, line 4, strike "fund" and insert in lieu thereof "reserve".

6. On page 2, line 7, strike "fund" and insert in lieu thereof "reserve".

7. On page 2, line 8, strike "fund. Money in the fund" and insert in lieu thereof "reserve. Except as provided in Subsection C of this section, money in the reserve".

8. On page 2, line 15, strike "fund" and insert in lieu thereof "reserve".

9. On page 2, line 18, strike "fund" and insert in lieu thereof "reserve".

10. On page 2, line 21, strike "fund" and insert in lieu thereof "reserve".

11. On page 2, line 25, strike "fund" and insert in lieu thereof "reserve".

12. On page 3, line 1, strike the quotation mark.

13. On page 3, between lines 1 and 2, insert the following subsection:

"C. If general fund balances, including all authorized revenues and transfers to the general fund and balances in the general fund operating reserve, but excluding balances in the tobacco settlement permanent reserve, are insufficient to meet the level of appropriations authorized from the general fund and, after all balances in the general fund operating reserve have been expended, then, upon specific authorization from the legislature, the amounts authorized by the legislature shall be transferred from the tobacco settlement permanent reserve to the general fund for the purpose of meeting those appropriations."".

14. On page 3, line 9, strike "fund" and insert in lieu thereof "reserve".
