MAKING AN APPROPRIATION TO FACILITATE NEGOTIATION OF RECOMPENSE FOR THE PUEBLO OF ZIA FOR THE USE OF THE ZIA SYMBOL BY THE STATE OF NEW MEXICO.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--

A. Fifty thousand dollars ($50,000) is appropriated from the general fund to the New Mexico office of Indian affairs for expenditure in fiscal year 2001 to facilitate a process between the pueblo of Zia and a negotiating team of six people, two appointed by the governor of the state, two appointed by the president pro tempore of the senate and two appointed by the speaker of the house of representatives of the New Mexico legislature, to determine how the pueblo should be compensated for use of its sacred sun symbol since 1925. The team shall also negotiate:

(1) appropriate wording for an acknowledgment of and an apology from the state for the unauthorized use by the state of the sacred Zia sun symbol for the last seventy-five years; and

(2) an authorized and just compensation to the pueblo for a license for the future use of the sacred Zia Sun symbol.

B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2001 shall revert to the general fund.
