AN ACT

RELATING TO EDUCATION; PROVIDING FOR THE CONTRACTION OF TECHNICAL AND VOCATIONAL INSTITUTE DISTRICTS UNDER CERTAIN CONDITIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the Technical and Vocational Institute Act is enacted to read:

"[NEW MATERIAL] CONTRACTION OF DISTRICTS.--

A. If, as a result of the creation of a new school district, only a portion of the new school district is included within an existing technical and vocational institute district, then the technical and vocational institute district may be contracted to exclude that portion of the new school district. The district may be contracted in the following manner:

(1) a petition for contraction, signed by ten percent of the registered voters residing in the area proposed to be excluded, shall be filed with the state board of education;

(2) upon a determination by the state board of education that the requisite number of registered voters has signed the petition, the state board of education shall call a special election for the purpose of referring the question of contraction to the registered voters residing in the area proposed to be excluded; and

(3) if a majority of the registered voters voting at the special election authorizes the contraction, the district shall be contracted to exclude that portion within the new school district.

B. Nothing in this section diminishes any obligation to pay district debts and liabilities outstanding on the date of the contraction. All taxes previously levied on property within the excluded area for the purpose of paying the outstanding debts and liabilities, including principal and interest on outstanding bonds, shall continue until the debts and liabilities are satisfied."
