AN ACT

RELATING TO PREPAID TELEPHONE CARDS; LIMITING TAXES AND OTHER CHARGES ON CARDS SOLD IN NEW MEXICO; LIMITING ROUNDING; PROVIDING PENALTIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. PREPAID TELEPHONE CARDS--CHARGES LIMITED--CONSUMER NOTIFICATION.--

A. No taxes, fees or other charges except those specifically authorized by state or federal law shall be charged against prepaid telephone cards sold in New Mexico. When a consumer uses a prepaid telephone card sold in New Mexico in less than full-minute increments, the prepaid telephone card provider shall not charge more than the next nearest full minute.

B. A prepaid telephone card provider who violates a provision of Subsection A of this section is guilty of a misdemeanor and shall be sentenced in accordance with Section 31-19-1 NMSA 1978. Each violation for each telephone card is a single offense.

C. The criminal penalty provided in Subsection B of this section shall not limit any other rights of action the consumer or the state may have under the Unfair Practices Act or other state or federal laws.
