REQUESTING THAT APPROPRIATE INTERIM LEGISLATIVE COMMITTEES REVIEW ISSUES ATTENDANT TO THE PROVISION OF ARREST RECORD INFORMATION REGARDING A JUVENILE TO THE PRINCIPAL OF THE SCHOOL THAT THE JUVENILE ATTENDS.
WHEREAS, under current law, if a juvenile commits a criminal offense off of school premises, law enforcement agencies are not authorized to notify school officials concerning the arrest or detention of the juvenile; and
WHEREAS, given the disturbing occurrence of violent acts in our nation's schools, the security and safety of our children might be enhanced if school officials were provided with such arrest record information;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the legislative education study committee and an interim committee with jurisdiction regarding juvenile justice issues be requested to review issues attendant to the provision of arrest record information regarding a juvenile to the principal of the school that the juvenile attends; and
BE IT FURTHER RESOLVED that the committees review issues concerning whether school principals should be authorized to use arrest record information regarding a juvenile to impose disciplinary measures against the juvenile; and
BE IT FURTHER RESOLVED that copies of this memorial be sent to the chairman of the legislative education study committee and the co-chairmen of the New Mexico legislative council.
