AN ACT

MAKING AN APPROPRIATION TO PROVIDE SERVICES FOR THE STATE'S DEVELOPMENTALLY DISABLED POPULATION NOT CURRENTLY RECEIVING SERVICES DUE TO INSUFFICIENT FUNDING; DECLARING AN EMERGENCY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--

A. Twenty-two million dollars ($22,000,000) is appropriated from the general fund to the department of health for expenditure in fiscal years 1999 and 2000 for the purpose of providing services for persons eligible and in need of services for the developmentally disabled in the following amounts for the following purposes:

(1) nine million three hundred ninety-six thousand dollars ($9,396,000) to serve persons under the developmentally disabled waiver program; and

(2) twelve million six hundred four thousand dollars ($12,604,000) to provide minimal personal support services to persons not enrolled in the developmentally disabled waiver program.

B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2000 shall revert to the general fund.

Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
