RELATING TO TELEPHONE YELLOW PAGES REVENUE; REGULATING ADVERTISING RATES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. PUBLIC REGULATION COMMISSION--REGULATION OF YELLOW PAGES ADVERTISING RATES.--

A. The public regulation commission shall regulate the rates of telephone yellow pages advertising to:

(1) prohibit the exorbitant cost of yellow pages advertising;

(2) eliminate the disproportionate disadvantage that new and small businesses face for yellow pages advertising;

(3) prevent monopolies pursuant to Article 4, Section 38 of the constitution of New Mexico; and

(4) provide for a fair rate of return for the company that publishes the yellow pages.

B. The public regulation commission shall include all yellow pages advertising revenue in determining the rates that can be charged for telecommunications services.
