AN ACT

MAKING AN APPROPRIATION FOR DIVERSION OF OFFENDERS TO INTERMEDIATE SANCTIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--

A. The following amounts are appropriated from the general fund to the community corrections division of the corrections department for expenditure in fiscal year 2000 for the following purposes:

(1) two million three hundred fifty-five thousand dollars ($2,355,000) to contract for intermediate sanction spaces in the following manner:

(a) forty new spaces in halfway houses;

(b) forty new spaces in day reporting centers;

(c) one hundred twenty new spaces in in-state residential drug treatment facilities; and

(d) sixty new spaces in intensive supervision probation; and

(2) ninety-six thousand dollars ($96,000) for staff to enhance the monitoring and review of community corrections contracts.

B. Two hundred sixteen thousand one hundred eighty dollars ($216,180) is appropriated from the general fund to the public defender department for expenditure in fiscal year 2000 to hire social workers to facilitate assessment, evaluation and placing of offenders who are sentenced to intermediate sanctions.

C. Any unexpended or unencumbered balance remaining at the end of fiscal year 2000 shall revert to the general fund.
