0011| AMENDING LAWS 1998, CHAPTER 116, SECTION 6; MAKING

0012| APPROPRIATIONS; DECLARING AN EMERGENCY.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Laws 1998, Chapter 116, Section 6 is amended
|
0016| to read:
|
0017| "Section 6. ADDITIONAL NEW MEXICO WORKS ACT AND
|
0018| WELFARE-TO-WORK APPROPRIATIONS.--The following amounts are
|
0019| appropriated from the funds as indicated for the purposes
|
0020| specified. Unless otherwise indicated, the appropriations are
|
0021| for expenditure in fiscal year 1999. Any unexpended or
|
0022| unencumbered balances of the general fund appropriation
|
0023| remaining at the end of fiscal year 1999 shall revert to the
|
0024| general fund.
|
0025| A. Five million dollars ($5,000,000) is
|

0001| appropriated from the general fund to the children, youth and
|
0002| families department to expand the headstart program to serve
|
0003| participants as defined in the New Mexico Works Act.
|
0004| Expenditure of any of the appropriation is contingent upon
|
0005| certification by the secretary of human services to the
|
0006| secretary of finance and administration that the children,
|
0007| youth and families department has entered into an agreement
|
0008| with the human services department that provides for
|
0009| appropriate administrative and accounting procedures and
|
0010| oversight by the human services department to ensure that
|
0011| expenditures will meet all federal and state requirements for
|
0012| maintenance of effort; and monthly reports of all expenditures
|
0013| by the children, youth and families department to the
|
0014| department of finance and administration, the welfare reform
|
0015| oversight committee and the legislative finance committee.
|
0016| The appropriation shall not be expended for the purpose of
|
0017| matching federal funds or for any other purpose that may
|
0018| jeopardize its classification as maintenance of effort. The
|
0019| appropriation shall be reported by the human services
|
0020| department as maintenance of effort and included in the state
|
0021| plan for the temporary assistance for needy families block
|
0022| grant.
|
0023| [B. Two hundred thousand dollars ($200,000) is
|
0024| appropriated from the general fund to the Martin Luther King,
|
0025| Jr. commission to provide job training to participants as
|

0001| defined in the New Mexico Works Act. Expenditure of any of
|
0002| the appropriation is contingent upon certification by the
|
0003| secretary of human services to the secretary of finance and
|
0004| administration that the Martin Luther King, Jr. commission
|
0005| has entered into an agreement with the human services
|
0006| department that provides for: appropriate administrative and
|
0007| accounting procedures and oversight by the human services
|
0008| department to ensure that expenditures will meet all federal
|
0009| and state requirements for maintenance of effort; and monthly
|
0010| reports of all expenditures by the Martin Luther King, Jr.
|
0011| commission to the department of finance and administration,
|
0012| the welfare reform oversight committee and the legislative
|
0013| finance committee. The appropriation shall not be expended
|
0014| for the purpose of matching federal funds, or for any other
|
0015| purpose that may jeopardize its classification as maintenance
|
0016| of effort. The appropriation shall be reported by the human
|
0017| services department as maintenance of effort and included in
|
0018| the state plan for the temporary assistance for needy families
|
0019| block grant.
|
0020| C. Five hundred thousand dollars ($500,000) is
|
0021| appropriated from the general fund to the commission on the
|
0022| status of women to establish and operate work development
|
0023| programs for participants as defined in the New Mexico Works
|
0024| Act. Expenditure of any of the appropriation is contingent
|
0025| upon certification by the secretary of human services to the
|

0001| secretary of finance and administration that the commission on
|
0002| the status of women has entered into an agreement with the
|
0003| human services department that provides for: appropriate
|
0004| administrative and accounting procedures and oversight by the
|
0005| human services department to ensure that expenditures will
|
0006| meet all federal and state requirements for maintenance of
|
0007| effort; and monthly reports of all expenditures by the
|
0008| commission on the status of women to the department of finance
|
0009| and administration, the welfare reform oversight committee and
|
0010| the legislative finance committee. The appropriation shall
|
0011| not be expended for the purpose of matching federal funds, or
|
0012| for any other purpose that may jeopardize its classification
|
0013| as maintenance of effort. The appropriation shall be reported
|
0014| by the human services department as maintenance of effort and
|
0015| included in the state plan for the temporary assistance for
|
0016| needy families block grant.
|
0017| D. Five hundred thousand dollars ($500,000) is
|
0018| appropriated from the general fund to western New Mexico
|
0019| university to provide job training in areas of high
|
0020| unemployment to participants as defined in the New Mexico
|
0021| Works Act. Expenditure of any of the appropriation is
|
0022| contingent upon certification by the secretary of human
|
0023| services to the secretary of finance and administration that
|
0024| western New Mexico university has entered into an agreement
|
0025| with the human services department that provides for:
|

0001| appropriate administrative and accounting procedures and
|
0002| oversight by the human services department to ensure that
|
0003| expenditures will meet all federal and state requirements for
|
0004| maintenance of effort; and monthly reports of all expenditures
|
0005| by western New Mexico university to the department of finance
|
0006| and administration, the welfare reform oversight committee and
|
0007| the legislative finance committee. The appropriation shall
|
0008| not be expended for the purpose of matching federal funds, or
|
0009| for any other purpose that may jeopardize its classification
|
0010| as maintenance of effort. The appropriation shall be reported

0011| by the human services department as maintenance of effort and
|
0012| included in the state plan for the temporary assistance for

0013| needy families block grant.

0014| E. One million dollars ($1,000,000) is
|
0015| appropriated from the general fund to the department of health
|
0016| to provide non-medical, out-patient substance abuse counseling
|
0017| for participants as defined in the New Mexico Works Act.

0012| appropriated from the general fund to the department of health
|

|
0015| as defined in the New Mexico Works Act. Expenditure of any of
|
0016| the appropriation is contingent upon certification by the
|
0017| secretary of human services to the secretary of finance and

|
0019| an agreement with the human services department that provides
|
0020| for: appropriate administrative and accounting procedures and
|
0021| oversight by the human services department to ensure that
|
0022| expenditures will meet all federal and state requirements for
|
0023| maintenance of effort; and monthly reports of all expenditures
|
0024| by the department of health to the department of finance and
|
0025| administration, the welfare reform oversight committee and the
|

0001| legislative finance committee. The appropriation shall not be

0003| other purpose that may jeopardize its classification as

0008| G. Two million four hundred eighty-two thousand
|
0009| five hundred dollars ($2,482,500) is appropriated from the
|
0010| general fund to the educational technology fund to purchase
|
0011| educational technology pursuant to the Technology for
|
0012| Education Act. (22-15A-1 to 22-15A-10 NMSA 1978) to serve
|
0013| participants as defined in the New Mexico Works Act.
|
0014| Expenditure of any of the appropriation is contingent upon
|
0015| certification by the secretary of human services to the
|
0016| secretary of finance and administration that the state
|
0017| department of education has entered into an agreement with the
|
0018| human services department that provides for: appropriate
|
0019| administrative and accounting procedures and oversight by the
|
0020| human services department to ensure that expenditures will
|
0021| meet all federal and state requirements for maintenance of
|
0022| effort; and monthly reports of all expenditures by the state
|
0023| department of education to the department of finance and
|
0024| administration, the welfare reform oversight committee and the
|
0025| legislative finance committee. The appropriation shall not be
|

0007| B. Two hundred thousand dollars ($200,000) is
|
0008| appropriated from the general fund to the human services
|
0009| department to develop programs in cooperation with the Martin
|
0010| Luther King, Jr. commission to provide services for
|
0011| participants as defined in the New Mexico Works Act. The
|
0012| programs developed shall maintain a work-first concept,
|
0013| contain measurable performance standards, identify the number
|
0014| of target clients and provide a tracking and reporting
|
0015| element. The appropriation shall not be expended for any
|
0016| purpose that may jeopardize its classification as maintenance
|
0017| of effort. The human services department shall ensure that
|
0018| expenditures meet all federal and state requirements for
|
0019| maintenance of effort. The appropriation shall be reported by
|
0020| the human services department as maintenance of effort. The
|
0021| human services department shall report quarterly to the
|
0022| welfare reform oversight committee on the programs developed.
|
0023| C. Five hundred thousand dollars ($500,000) is
|
0024| appropriated from the general fund to the commission on the
|
0025| status of women to develop, establish and operate job
|

0001| placement programs for participants as defined in the New
|
0002| Mexico Works Act that are referred to the commission by the
|
0003| department. In developing, establishing and operating these
|
0004| job placement programs, the commission shall cooperate and
|
0005| coordinate with the human services department. Prior to the
|
0006| expenditure of any of the appropriation, the commission shall
|
0007| seek the approval of each program it develops from the
|
0008| department. Expenditure of any of the appropriation is
|
0009| contingent upon certification by the secretary of human
|
0010| services to the department of finance and administration that
|
0011| the commission has entered into an agreement with the human
|
0012| services department that provides for programs that maintain a
|
0013| work-first concept; programs that contain measurable
|
0014| performance standards; programs that identify the number of
|
0015| target clients; programs that provide a tracking and reporting
|
0016| element; and appropriate administrative and accounting
|
0017| procedures and oversight by the human services department to
|
0018| ensure that expenditures shall meet all federal and state
|
0019| requirements for maintenance of effort, including adherence to
|
0020| the cap on administrative costs. Additionally, the commission
|
0021| shall provide quarterly reports of all its expenditures to the
|
0022| human services department, the welfare reform oversight
|
0023| committee and the legislative finance committee. The
|
0024| appropriation shall not be expended for any purpose that may
|
0025| jeopardize its classification as maintenance of effort. The
|

0001| appropriation shall be reported by the human services
|
0002| department as maintenance of effort.
|
0003| D. Five hundred thousand dollars ($500,000) is
|
0004| appropriated from the general fund to the regents of western
|
0005| New Mexico university to provide job training and placement
|
0006| for participants as defined in the New Mexico Works Act that
|
0007| are referred to western New Mexico university by the
|
0008| department. In providing job training and placement for
|
0009| participants, western New Mexico university shall coordinate
|
0010| and cooperate with the human services department. Prior to
|
0011| the expenditure of any of the appropriation, western New
|
0012| Mexico university shall seek the approval of each program it
|
0013| develops from the human services department. Expenditure of
|
0014| any of the appropriation is contingent upon certification by
|
0015| the secretary of human services to the department of finance
|
0016| and administration that western New Mexico university has
|
0017| entered into an agreement with the human services department
|
0018| that provides for programs that maintain a work-first concept;
|
0019| programs that contain measurable performance standards;
|
0020| programs that identify the number of target clients; programs
|
0021| that provide a tracking and reporting element; and appropriate
|
0022| administrative and accounting procedures and oversight by the
|
0023| human services department to ensure that expenditures shall
|
0024| meet all federal and state requirements for maintenance of
|
0025| effort, including adherence to the cap on administrative
|

0001| costs. Additionally, western New Mexico university shall
|
0002| provide quarterly reports of all the expenditures in these job
|
0003| training and placement programs to the human services
|
0004| department, the welfare reform oversight committee and the
|
0005| legislative finance committee. The appropriation shall not be

0006| expended for any purpose that may jeopardize its
|
0007| classification as maintenance of effort. The appropriation
|
0008| shall be reported by the human services department as
|
0009| maintenance of effort.
|
0010| E. One million dollars ($1,000,000) is
|
0011| appropriated from the general fund to the department of health
|
0012| to provide a one-time expenditure for substance abuse
|
0013| counseling for participants as defined pursuant to the New
|
0014| Mexico Works Act. The appropriation shall be reported by the
|
0015| labor department as a match for the federal welfare-to-work
|
0016| grant. Expenditure of any of the appropriation is contingent
|
0017| upon certification by the secretary of labor to the secretary
|
0018| of finance and administration that the department of health
|
0019| has entered into an agreement with the labor department that
|
0020| provides for appropriate administrative and accounting
|
0021| procedure and oversight by the labor department to ensure that
|
0022| the expenditure meets all federal and state requirements for
|
0023| the match for the federal welfare-to-work grant. The
|
0024| appropriation shall not be expended for any purpose that may
|
0025| jeopardize its classification as match for the federal
|

0001| welfare-to-work grant.
|
0002| F. Two million dollars ($2,000,000) is
|
0003| appropriated from the general fund to the human services
|
0004| department to provide job training and placement services to

0005| participants as defined in the New Mexico Works Act that

0016| G. Two million four hundred eighty-two thousand

0017| five hundred dollars ($2,482,500) is appropriated from the
|
0018| general fund to the human services department to develop early
|
0019| childhood-family support and education training programs with
|
0020| the state department of public education to provide before-
|
0021| and after-school programs to students who are participants as
|
0022| defined in the New Mexico Works Act. The programs developed
|
0023| shall contain measurable performance standards, identify the
|
0024| number of target clients and provide a tracking and reporting
|
0025| element. The appropriation shall not be expended for any
|

0001| purpose that may jeopardize its classification as maintenance
|
0002| of effort. The human services department shall ensure that
|
0003| expenditures meet all federal and state requirements for
|
0004| maintenance of effort. The appropriation shall be reported by
|
0005| the human services department as maintenance of effort. The
|
0006| human services department shall report to the welfare reform
|
0007| oversight committee on the programs developed.
|
0008| H. Five hundred thousand dollars ($500,000) is
|
0009| appropriated from the general fund to the department of health
|
0010| to provide a one-time expenditure for substance abuse

0001| [K.] I. Thirteen million eight hundred thirty-
|
0002| eight thousand dollars ($13,838,000) is appropriated from the
|
0003| temporary assistance for needy families block grant to the
|
0004| human services department for training participants to become
|
0005| licensed daycare providers and for other services as defined
|
0006| in the New Mexico Works Act.
|
0007| [L.] J. Of the general fund appropriations
|
0008| made to the human services department in Section 4 of the
|
0009| General Appropriation Act of 1998, the human services
|
0010| department shall report [the following] six hundred
|
0011| thousand dollars ($600,000) in the department's child support
|
0012| enforcement division for child support enforcement pass-
|
0013| throughs to participants as defined in the New Mexico Works
|
0014| Act as maintenance of effort for the temporary assistance for
|
0015| needy families block grant. [and shall include the
|
0016| appropriations in the state plan: two million two hundred
|
0017| twenty-eight thousand one hundred dollars ($2,228,100) for
|
0018| adult basic education; two hundred ten thousand seven hundred
|
0019| dollars ($210,700) for the at-risk youth program in the labor
|
0020| department; one million four hundred thousand dollars
|
0021| ($1,400,000)for the youth conservation corps in the energy,
|
0022| minerals and natural resources department which includes
|
0023| sixty-five thousand dollars ($65,000) to provide a youth
|
0024| corp/youth build program to provide high risk youth service
|
0025| learning opportunities and provide them with valuable
|

0001| construction, entrepreneurial, employability, academic and
|
0002| leadership training in the city of Albuquerque, Bernalillo
|
0003| county; and eighty-two thousand dollars ($82,000) to provide a
|
0004| program for at-risk youth to clean up and provide fire
|
0005| prevention between Cochiti dam and the headwaters of Elephant
|
0006| Butte reservoir; and six hundred thousand dollars ($600,000)
|
0007| in the child support enforcement division of the human
|
0008| services department for child support enforcement pass-
|
0009| throughs to participants as defined in the New Mexico Works
|
0010| Act. The state department of education, the labor department
|
0011| and the energy, minerals and natural resources department
|
0012| shall each enter into an agreement with the human services
|
0013| department that provides for: appropriate administrative and
|
0014| accounting procedures and oversight by the human services
|
0015| department to ensure that expenditures will meet all federal
|
0016| and state requirements for maintenance of effort; and monthly
|
0017| reports of all expenditures by the recipient agency to the
|
0018| department of finance and administration, the welfare reform
|
0019| oversight committee and the legislative finance committee.]
|
0020| K. Of the general fund appropriations made to the
|
0021| state department of public education in Section 4 of the
|
0022| General Appropriation Act of 1998, the labor department shall
|
0023| report six hundred thousand dollars ($600,000) for the adult
|
0024| basic education match as a match for the federal welfare-to-
|
0025| work grant. The state department of public education shall
|

0001| enter into an agreement with the labor department that
|
0002| provides for appropriate administrative and accounting
|
0003| procedure and oversight by the labor department to ensure that
|
0004| the expenditure meets all federal and state requirements for
|
0005| the match for the federal welfare-to-work grant. The
|
0006| appropriation shall not be expended for any purpose that may
|
0007| jeopardize its classification as match for the federal
|
0008| welfare-to-work grant.
|
0009| L. Of the general fund appropriations made to the
|
0010| children, youth and families department in Section 4 of the
|
0011| General Appropriation Act of 1998 for the child care
|
0012| development block grant in the children, youth and families
|
0013| department, up to two million eight hundred thousand dollars
|
0014| ($2,800,000) and not less than two million dollars
|
0015| ($2,000,000) shall be counted as maintenance of effort for the
|
0016| temporary assistance for needy families block grant.
|
0017| M. The human services department shall report any
|
0018| amount of general assistance payments made to lawfully
|
0019| admitted immigrant families as maintenance of effort and
|
0020| include the payments in the state plan for the temporary
|
0021| assistance for needy families block grant.
|
0022| N. Four million dollars ($4,000,000) is
|
0023| appropriated from the general fund operating reserve to the
|
0024| department of finance and administration. Any unexpended or
|
0025| unencumbered balance remaining at the end of fiscal year 1999
|

0001| shall revert to the general fund operating reserve. The
|
0002| appropriation, or so much thereof as is necessary, shall be
|
0003| distributed to the human services department for the purpose
|
0004| of meeting the state and federal requirements for maintenance
|
0005| of effort. No distribution shall be made until
|
0006| [(1) the human services department has
|
0007| certified that it has exhausted every effort to meet the
|
0008| requirements with available funds and programs but that one or
|
0009| more of the appropriations and programs provided in this
|
0010| section have not been operational, sufficient temporary
|
0011| assistance for needy families eligibles have not been served,
|
0012| and additional funds are necessary to meet the requirements
|
0013| for maintenance of effort;
|
0014| (3)] the distribution has been approved by
|
0015| the secretary of finance and administration."
|
0016| Section 2. EMERGENCY.--It is necessary for the public
|
0017| peace, health and safety that this act take effect
|
0018| immediately.
