0011| RELATING TO PUBLIC ASSISTANCE; PROVIDING FOR AN EARLY

0012| CHILDHOOD-FAMILY SUPPORT AND EDUCATION TRAINING PROGRAM;
|
0013| MAKING AN APPROPRIATION; DECLARING AN EMERGENCY.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. A new section of the Public School Code is
|
0017| enacted to read:
|
0018| "[NEW MATERIAL] EARLY CHILDHOOD-FAMILY SUPPORT AND
|
0019| EDUCATION TRAINING PROGRAM.--
|
0020| A. The human services department shall work with
|
0021| the department of education and the children, youth and
|
0022| families department to develop and implement the early
|
0023| childhood-family support and education training program for
|
0024| eligible families pursuant to the New Mexico Works Act. This
|
0025| early childhood-family support and education training program
|

0001| shall not be available to persons who are not members of an
|
0002| eligible family pursuant to the New Mexico Works Act.
|
0003| B. The department of education, upon approval of
|
0004| an application, shall distribute money to those school
|
0005| districts that address the following program elements:
|
0006| (1) implementation or augmentation of before-
|
0007| and after-school programs for eligible children pursuant to
|
0008| the New Mexico Works Act who are ages five through eight;
|
0009| (2) implementation or augmentation of
|
0010| programs addressing the educational needs and family support
|
0011| needs of eligible children pursuant to the New Mexico Works
|
0012| Act who are ages five through eight; and
|
0013| (3) implementation or augmentation of job
|
0014| skills and leadership development for mothers and fathers of
|
0015| participants who are eligible participants pursuant to the New
|
0016| Mexico Works Act.
|
0017| C. In applying for funding, school districts shall
|
0018| establish partnerships with local community-based public and
|
0019| private programs. Each funded application shall include and
|
0020| demonstrate a family involvement component that is based on
|
0021| family support principles for each of the program elements
|
0022| described in Subsection A of this section. School districts
|
0023| shall maintain fiscal agent responsibility in a partnership.
|
0024| D. The program shall reflect the employment and
|
0025| economic development needs of the local community and
|

0001| encompass health, safety and nutrition. The program shall
|
0002| support the educational and developmental needs of eligible
|
0003| children pursuant to the New Mexico Works Act, address
|
0004| cultural diversity and provide family support.
|
0005| E. By July 1, 1998, the state department of public
|
0006| education shall develop guidelines for the application
|
0007| process, disseminate those guidelines to all school districts
|
0008| and provide technical assistance in developing applications.
|
0009| The department, in partnership with the human services
|
0010| department and the children, youth and families department and
|
0011| interested persons, shall define application criteria
|
0012| inclusive of at-risk indicators, quality performance
|
0013| indicators and benchmarks that ensure positive results for
|
0014| participants and provide strong accountability measures for
|
0015| the public.
|
0016| F. A phase-in process may be instituted by a
|
0017| school district to develop the needed coordination with local
|
0018| community-based public and private programs and other
|
0019| resources.
|
0020| G. The human services department shall make
|
0021| referrals of families eligible pursuant to the New Mexico
|
0022| Works Act to the school districts whose application is
|
0023| approved.
|
0024| H. The human services department shall ensure that
|
0025| expenditures meet all federal and state temporary assistance
|

0001| for needy families block grant maintenance of effort
|
0002| requirements.
|
0003| I. The department of education shall distribute
|
0004| money to school districts that are located in areas lacking
|
0005| certified childcare services as determined by the children,
|
0006| youth and families department."
|
0007| Section 2. APPROPRIATION. Two million four hundred
|
0008| eighty-two thousand five hundred dollars ($2,482,500) is
|
0009| appropriated from the general fund to the human services
|
0010| department for expenditure in fiscal year 1999 for the purpose
|
0011| of carrying out the early childhood-family support and
|
0012| education training program. Any unexpended or unencumbered
|
0013| balance remaining at the end of fiscal year 1999 shall revert
|
0014| to the general fund.
|
0015| Section 3. EMERGENCY.--It is necessary for the public
|
0016| peace, health and safety that this act take effect
|
0017| immediately.
