0011|     MAKING APPROPRIATIONS TO THE SPACE COMMERCIALIZATION DIVISION
    |
0012|     OF THE ECONOMIC DEVELOPMENT DEPARTMENT TO DEVELOP A PROPOSAL
    |
0013|     AND PROVIDE MATCHING FUNDS FOR CONSTRUCTION OF A SPACEPORT
    |
0014|     SITE FOR REUSABLE LAUNCH VEHICLES; DECLARING AN EMERGENCY.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  APPROPRIATION.--Three hundred eighty thousand
    |
0018|     dollars ($380,000) is appropriated from the general fund to
    |
0019|     the space commercialization division of the economic
    |
0020|     development department for expenditure in fiscal years 1998
    |
0021|     and 1999 to secure New Mexico as designee for development of a
    |
0022|     spaceport site for reusable aerospace launch vehicles. Any
    |
0023|     unexpended or unencumbered balance remaining at the end of
    |
0024|     fiscal year 1999 shall revert to the general fund.
    |
0025|          Section 2.  APPROPRIATION--CONTINGENCY.--Eight million
    |

0001|     six hundred thousand dollars ($8,600,000) is appropriated from
    |
0002|     the general fund operating reserve to the space
    |
0003|     commercialization division of the economic development
    |
0004|     department for expenditure in fiscal year 1999 or in any
    |
0005|     succeeding fiscal year to provide matching funds not to exceed
    |
0006|     ten percent of the costs of designing and constructing roads,
    |
0007|     runways and other infrastructure for a spaceport site
    |
0008|     contingent upon receipt of the remaining funds for such design
    |
0009|     and construction from private or federal sources, and upon
    |
0010|     selection of New Mexico for development of a spaceport site
    |
0011|     for reusable aerospace launch vehicles.  The disbursement of
    |
0012|     any amount of the appropriation is contingent upon
    |
0013|     certification by the secretary of finance and administration
    |
0014|     and notification of the legislative finance committee that the
    |
0015|     disbursement represents not more than ten percent of the
    |
0016|     proposed expenditure; that a matching amount of private or
    |
0017|     federal funds equal to at least ninety percent of the proposed
    |
0018|     expenditure is available within twelve months of the
    |
0019|     disbursement; and that the contracts for the proposed design
    |
0020|     or construction are pending and can be executed upon receipt
    |
0021|     of the money.  Any unexpended or unencumbered balance
    |
0022|     remaining from this appropriation on July 1, 2005 shall remain
    |
0023|     in the general fund operating reserve.
    |
0024|          Section 3.  EMERGENCY.--It is necessary for the public
    |
0025|     peace, health and safety that this act take effect
    |
