0011| PROPOSING TO SELL LA VILLA RIVERA, MARIAN HALL AND CATHEDRAL

0012| PARK IN SANTA FE IN SANTA FE COUNTY.

0014| WHEREAS, Section 13-6-3 NMSA 1978 requires ratification
|
0015| and approval of any sale of real property by a state agency
|
0016| for a consideration of one hundred thousand dollars ($100,000)
|
0017| or more; and
|
0018| WHEREAS, the property control division of the general
|
0019| services department is desirous of selling real property and
|
0020| improvements, legal description set forth below; and
|
0021| WHEREAS, the property control division proposes to sell
|
0022| La Villa Rivera, Marian hall and Cathedral park in Santa Fe
|
0023| county, New Mexico and more particularly described as:

0024| Beginning at a point marked by a 1/2" rebar on the
|
0025| southerly side of East Palace Avenue, whence the

0002| intersection of Cathedral Place and East Palace

0002| shown on that certain plat of survey entitled "PLAT

0003| OF SURVEY FOR SISTERS OF CHARITY ST. VINCENT'S

0004| HOSPITAL WARD NO. 4 SANTA FE, NEW MEXICO", prepared
|
0005| from a survey completed in the field on October 12,
|
0006| 1973 by George Rivera, Registered Professional Land
|
0007| Surveyor No. 3149;
|
0008| TOGETHER WITH all buildings, improvements and fixtures
|
0009| located thereon or appurtenant thereto;
|
0010| WITH WARRANTY COVENANTS.

0011| By acceptance of this deed, the grantee
|
0012| covenants and agrees that the above-described
|
0013| property shall not, at any time prior to October 1,
|
0014| 2001, be used for a use which is competitive with
|
0015| the grantor's use of the facility known as "St.
|
0016| Vincent Hospital" on St. Michaels' Drive in Santa
|
0017| Fe, New Mexico, as an acute care hospital.; and
|
0018| WHEREAS, the property shall not be sold for less than the
|
0019| value of the property established by the taxation and revenue
|
0020| department using generally acceptable appraisal techniques for
|
0021| this type of property after review by the capitol buildings
|
0022| planning commission;
|
0023| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0024| STATE OF NEW MEXICO that the proposed sale be hereby ratified
|
0025| and approved pursuant to the provisions of Section 13-6-3 NMSA
|

|
0002| BE IT FURTHER RESOLVED that a copy of this resolution be
|
0003| transmitted to the property control division of the general
|
0004| services department.
