0011|     PROPOSING AN AMENDMENT TO ARTICLE 4, SECTION 3 OF THE

0012|     CONSTITUTION OF NEW MEXICO TO DISQUALIFY GOVERNMENT EMPLOYEES

0013|     FROM SERVING AS STATE LEGISLATORS.

0015|     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  It is proposed to amend Article 4, Section 3
    |
0017|     of the constitution of New Mexico to read:
    |
0018|               "A.  Senators shall not be less than twenty-five
    |
0019|     years of age and representatives not less than twenty-one
    |
0020|     years of age at the time of their election.  If any senator or
    |
0021|     representative permanently removes his residence from or
    |
0022|     maintains no residence in the district from which he was
    |
0023|     elected, then he shall be deemed to have resigned and his
    |
0024|     successor shall be selected as provided in Section 4 of this
    |
0025|     article.  No person shall be eligible to serve in the
    |

0001|     legislature who, at the time of qualifying, <s>[holds any office
</s>    |
<s></s>0002| <s>    of trust or profit with the]</s> <u>is a</u> state, county or national
    |
0003|     <s>[governments]</s> <u>government employee</u>, except notaries public
    |
0004|     and officers of the militia who receive no salary.  <u>For the
</u>    |
<u></u>0005| <u>    purpose of this provision, public school district employees
</u>    |
<u></u>0006| <u>    shall be considered "state government employees".</u>
    |
0007|               B.  The senate shall be composed of no more than
    |
0008|     forty-two members elected from single-member districts. 
    |
0009|               C.  The house of representatives shall be composed
    |
0010|     of no more than seventy members elected from single-member
    |
0011|     districts. 
    |
0012|               D.  Once following publication of the official
    |
0013|     report of each federal decennial census hereafter conducted,
    |
0014|     the legislature may by statute reapportion its membership."
    |
0015|          Section 2.  The amendment proposed by this resolution
    |
0016|     shall be submitted to the people for their approval or
    |
0017|     rejection at the next general election or at any special
    |
0018|     election prior to that date which may be called for that
    |
0019|     purpose.
