It is proposed to amend Article 11, Section 1 | 0017| of the constitution of New Mexico to read: | 0018| "The "public regulation commission" is created. The | 0019| commission shall consist of five members [elected from | 0020| districts provided by law] appointed for staggered four- | 0021| year terms [beginning on January 1 of the year following | 0022| their election; provided that those chosen at the first]. | 0023| Members elected at the 1998 general election [after the | 0024| adoption of this section] shall immediately classify | 0025| themselves by lot, so that two of them shall hold office for | - 1 - 0001| two years and three of them for four years [and further | 0002| provided that, after serving two terms, members shall be | 0003| ineligible to hold office as a commission member until one | 0004| full term has intervened. No commissioner or candidate for | 0005| the commission shall accept anything of value from a person or | 0006| entity whose charges for services to the public are regulated | 0007| by the commission], and thereafter the members shall be | 0008| appointed by the governor and confirmed by the senate. The | 0009| legislature shall provide by law for the ethical conduct of | 0010| the members." | 0011| Section 2. The provisions of this amendment shall take | 0012| effect January 1, 1999. | 0013| Section 3. The amendment proposed by this resolution | 0014| shall be submitted to the people for their approval or | 0015| rejection at the next general election or at any special | 0016| election prior to that date which may be called for that | 0017| purpose. | 0018|  |
