0012| RELATING TO PUBLIC PEACE, HEALTH, SAFETY AND WELFARE; CREATING

0013| A JOINT LEGISLATIVE TELECOMMUNICATIONS DEREGULATION INTERIM

0014| COMMITTEE; MAKING AN APPROPRIATION; DECLARING AN EMERGENCY.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. TELECOMMUNICATIONS COMMITTEE CREATED--
|
0018| TERMINATION.--The "telecommunications deregulation interim
|
0019| committee" is created as a joint interim legislative
|
0020| committee. The committee shall function from the date of its
|
0021| appointment until December 1 prior to the first session of the
|
0022| forty-fourth legislature.
|
0023| Section 2. MEMBERSHIP--APPOINTMENT--VACANCIES.--
|
0024| A. The telecommunications deregulation interim
|
0025| committee shall be composed of eight members. Four members of
|
- 1 -0001| the house of representatives shall be appointed by the speaker
|
0002| of the house of representatives, and four members of the
|
0003| senate shall be appointed by the committees' committee of the
|
0004| senate or, if the senate appointments are made in the interim,
|
0005| by the president pro tempore of the senate after consultation
|
0006| with and agreement of a majority of the members of the
|
0007| committees' committee.
|
0008| B. Members shall be appointed from each house so
|
0009| as to give the two major political parties in each house the
|
0010| same proportional representation on the committee as prevails
|
0011| in each house; however, in no event shall either party have
|
0012| less than one member from each house on the committee.
|
0013| Vacancies on the committee shall be filled by appointment in
|
0014| the same manner as the original appointments. The chairman
|
0015| and vice chairman of the committee shall be elected by the
|
0016| committee.
|
0017| C. No action shall be taken by the committee if a
|
0018| majority of the total membership from either house on the
|
0019| committee rejects such action.
|
0020| Section 3. DUTIES.--After its appointment, the
|
0021| telecommunications deregulation interim committee shall hold
|
0022| one organizational meeting to develop a work plan and budget
|
0023| for the ensuing interim. The work plan and budget shall be
|
0024| submitted to the New Mexico legislative council for approval.
|
0025| Upon approval of the work plan and budget by the legislative
|
- 2 -0001| council, the committee shall examine the statutes,
|
0002| constitutional provisions, regulations and court decisions
|
0003| governing the telecommunications industry and deregulation
|
0004| activity in New Mexico and recommend legislation or changes if
|
0005| any are found to be necessary to the first session of the
|
0006| forty-fourth legislature.
|
0007| Section 4. SUBCOMMITTEES.--Subcommittees shall be created
|
0008| only by majority vote of all members appointed to the
|
0009| telecommunications deregulation interim committee and with the
|
0010| prior approval of the New Mexico legislative council. A
|
0011| subcommittee shall be composed of at least one member from the
|
0012| senate and one member from the house of representatives, and at
|
0013| least one member of the minority party shall be a member of the
|
0014| subcommittee. All meetings and expenditures of a subcommittee
|
0015| shall be approved by the full committee in advance of such
|
0016| meeting or expenditure, and the approval shall be shown in the
|
0017| minutes of the committee.
|
0018| Section 5. REPORT.--The telecommunications deregulation
|
0019| interim committee shall make a report of its findings and
|
0020| recommendations for the consideration of the first session of the
|
0021| forty-fourth legislature. The report and suggested legislation
|
0022| shall be made available to the New Mexico legislative council on
|
0023| or before December 15 preceding that session.
|
0024| Section 6. STAFF.--The staff for the telecommunications
|
0025| deregulation interim committee shall be provided by the
|

|
0002| Section 7. APPROPRIATION.--For the purpose of paying the
|
0003| salaries and expenses of the technical, legal, clerical and
|
0004| stenographic assistants, including necessary expert witness
|
0005| testimony, for necessary equipment and supplies used in carrying
|
0006| out the provisions of this act and for reimbursing the per diem
|
0007| and mileage expenses of the telecommunications deregulation
|
0008| interim committee, there is appropriated to the legislative
|
0009| council service from the general fund the sum of seventy-five
|
0010| thousand dollars ($75,000). All or any part of this
|
0011| appropriation may be expended in fiscal years 1998 and 1999, and
|
0012| any unexpended or unencumbered balance remaining at the end of
|
0013| fiscal year 1999 shall revert to the general fund. Payments from
|
0014| the appropriation shall be made upon vouchers signed by the
|
0015| director of the legislative council service or his authorized
|
0016| representative.
|
0017| Section 8. EMERGENCY.--It is necessary for the public
|
0018| peace, health and safety that this act take effect immediately.
