0011|     RELATING TO RECORDING FEES; CHANGING THE PURPOSE FOR WHICH
    |
0012|     EQUIPMENT RECORDING FEES CAN BE USED.

0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  Section 14-8-12.2 NMSA 1978 (being Laws 1985,
    |
0016|     Chapter 122, Section 2, as amended) is amended to read:
    |
0017|          "14-8-12.2.  RECORDING FEES--WHEN INSTRUMENT IS
    |
0018|     PHOTOCOPIED.--
    |
0019|               A.  For each instrument recorded and when the
    |
0020|     instrument is photocopied, the county clerk shall charge a
    |
0021|     recording fee of five dollars ($5.00) for the first page and
    |
0022|     two dollars ($2.00) for each additional page or portion
    |
0023|     thereof of the same instrument.
    |
0024|               B.  For each instrument recorded and when the
    |
0025|     instrument is photocopied, the county clerk may charge, in
    |

0001|     addition to any other fees authorized by law, including the
    |
0002|     fee provided in Subsection A of this section, an equipment
    |
0003|     recording fee.  The equipment recording fee shall not exceed
    |
0004|     three dollars ($3.00) for each instrument recorded, except
    |
0005|     that in class A counties the equipment recording fee shall not
    |
0006|     exceed two dollars ($2.00).
    |
0007|               C.  Amounts collected from the equipment recording
    |
0008|     fee shall be deposited into a county clerk recording and
    |
0009|     filing fund, which shall be established by the county.  Money
    |
0010|     in the county clerk recording and filing fund shall be
    |
0011|     expended <s>[only]</s> to rent, purchase, lease or lease-purchase
    |
0012|     equipment associated with recording, filing, maintaining or
    |
0013|     reproducing documents in the county clerk's office;
    |
0014|     <u>remodeling the clerk's office to accommodate the equipment</u>;
    |
0015|     and for staff training on office procedures and equipment.
    |
0016|               D.  The equipment recording fee and expenditures
    |
0017|     from the county clerk recording and filing fund shall be
    |
0018|     determined annually by the county clerk and approved by the
    |
0019|     board of county commissioners."
