0011| RELATING TO ALTERNATIVE FUEL; MOVING THE ALTERNATIVE FUEL

0012| CONVERSION PROGRAM FROM THE GENERAL SERVICES DEPARTMENT TO THE
|
0013| ENERGY, MINERALS AND NATURAL RESOURCES DEPARTMENT.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 9-17-7 NMSA 1978 (being Laws 1992,
|
0017| Chapter 58, Section 8, as amended) is recompiled as Section
|
0018| 9-5A-8 NMSA 1978 and is amended to read:
|
0019| "9-5A-8. STATE ALTERNATIVE FUEL PROGRAM MANAGER--
|
0020| CREATION--DUTIES.--A "state alternative fuel program manager"
|
0021| is created in the [transportation services] energy
|
0022| conservation and management division of the [general
|
0023| services] energy, minerals and natural resources
|
0024| department, and his duties shall include:
|
0025| A. promoting, coordinating and monitoring the
|

0001| implementation of state clean alternative fuel transportation
|
0002| programs, including a mass transit demonstration project and
|
0003| other demonstration projects that place New Mexico on the
|
0004| leading edge of new clean fuel technologies;
|
0005| B. coordinating and directing the provisions of
|
0006| the Alternative Fuel Conversion Act; and
|
0007| C. mobilizing and coordinating necessary resources
|
0008| and expertise from government, education and the private
|
0009| sector to assist in clean alternative fuel transportation
|
0010| programs and projects."
|
0011| Section 2. Section 13-1B-2 NMSA 1978 (being Laws 1992,
|
0012| Chapter 58, Section 2, as amended) is amended to read:
|
0013| "13-1B-2. DEFINITIONS.--As used in the Alternative Fuel
|
0014| Conversion Act:
|
0015| A. "alternative fuel" means natural gas, liquefied
|
0016| petroleum gas, electricity, hydrogen, a fuel mixture
|
0017| containing not less than eighty-five percent ethanol or
|
0018| methanol or a water-phased hydrocarbon fuel emulsion
|
0019| consisting of a hydrocarbon base and water in an amount not
|
0020| less than twenty percent by volume of the total water-phased
|
0021| fuel emulsion;
|
0022| B. "conventional fuel" means gasoline or diesel
|
0023| fuel;
|
0024| C. "department" means the [general services]
|
0025| energy, minerals and natural resources department;
|

0001| D. "fund" means the alternative fuel conversion
|
0002| loan fund;
|
0003| E. "political subdivision" means a county,
|
0004| municipality or school district;
|
0005| F. "post-secondary institution" means two- and
|
0006| four-year public post-secondary institutions; and
|
0007| G. "vehicle" means a passenger car or light,
|
0008| medium or heavy duty truck."

0009| Section 3. TEMPORARY PROVISION--TRANSFER OF PERSONNEL,
|
0010| PROPERTY, CONTRACTS AND REFERENCES IN LAW.--On July 1, 1998:
|
0011| A. all personnel, appropriations, money, records,
|
0012| property, equipment and supplies of the state alternative fuel
|
0013| program shall be transferred to the energy, minerals and
|
0014| natural resources department;
|
0015| B. all contracts and other obligations of the
|
0016| general services department pertaining to the state
|
0017| alternative fuel program shall be binding and effective on the
|
0018| energy, minerals and natural resources department; and
|
0019| C. all references in law to the state alternative
|
0020| fuel program in the general services department shall be
|
0021| deemed to be references to the state alternative fuel program
|
0022| of the energy, minerals and natural resources department.
|
0023| Section 4. EFFECTIVE DATE.--The effective date of the
|
0024| provisions of this act is July 1, 1998.
