0011| RELATING TO EDUCATION; AMENDING THE INCENTIVES FOR SCHOOL

0012| IMPROVEMENT ACT.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 22-13A-2 NMSA 1978 (being Laws 1989,
|
0016| Chapter 137, Section 2, as amended) is amended to read:
|
0017| "22-13A-2. PURPOSE.--The purpose of the Incentives for
|
0018| School Improvement Act is to provide financial incentives to
|
0019| individual schools and teachers that exceed expected
|
0020| academic performance."
|
0021| Section 2. Section 22-13A-6 NMSA 1978 (being Laws 1989,
|
0022| Chapter 137, Section 6, as amended) is amended to read:
|
0023| "22-13A-6. FUND CREATED.--
|
0024| A. There is created in the state treasury the
|
0025| "incentives for school improvement fund". The fund shall
|

0001| consist of any state money appropriated to the fund, [any]
|
0002| federal money allocated to the state for the purposes of the
|
0003| Incentives for School Improvement Act, undistributed annual
|
0004| balances and earnings of the fund and [any] gifts or
|
0005| bequests made to the fund. The state treasurer shall invest
|
0006| the fund as other state funds are invested. The balance
|
0007| remaining in the fund at the end of the fiscal year shall not
|
0008| revert to the general fund.

0009| B. The fund is appropriated to the department for
|
0010| the purpose of implementing and administering the Incentives
|
0011| for School Improvement Act. No more than three percent of the
|
0012| fund may be retained by the department for administrative
|
0013| purposes.
|
0014| C. Money in the fund other than that used for
|
0015| administrative purposes shall be distributed directly to
|
0016| schools evidencing the greatest improvement as determined by
|
0017| the department. Disbursements shall be made only to that
|
0018| number of schools constituting not more than ten percent of
|
0019| the student membership in the state. Distributions shall be
|
0020| made proportionately to schools that qualify.
|
0021| D. Money received by a school from the fund
|
0022| shall not be used for salaries, salary increases or bonuses.
|
0023| Money in the fund may be used for a one-time salary
|
0024| adjustment that does not become part of the employee's wage
|
0025| base for future salary increment purposes. The one-time
|

0001| salary adjustment shall be paid in return for services
|
0002| currently rendered to the school. Money shall be used as
|
0003| determined by the school principal and teachers in cooperation
|
0004| with other school employees and the community."
