0011| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF

0012| SEVERANCE TAX BONDS; REAUTHORIZING UNEXPENDED OR UNENCUMBERED
|
0013| BALANCES; CHANGING AGENCIES AND PURPOSES OF CERTAIN BOND
|
0014| AUTHORIZATIONS AND FUND APPROPRIATIONS; EXTENDING EXPENDITURE
|
0015| PERIODS; AUTHORIZING EXPENDITURES; DECLARING AN EMERGENCY.
|

|
0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS--
|
0019| APPROPRIATION OF PROCEEDS.--
|
0020| A. The state board of finance may issue and sell
|
0021| severance tax bonds in compliance with the Severance Tax
|
0022| Bonding Act in an amount not to exceed the total of the
|
0023| amounts authorized for purposes specified in this act. The
|
0024| state board of finance shall schedule the issuance and sale of
|
0025| the bonds in the most expeditious and economical manner
|

0001| possible upon a finding by the board that the project has been
|
0002| developed sufficiently to justify the issuance and that the
|
0003| project can proceed to contract within a reasonable time. The
|
0004| state board of finance shall further take the appropriate
|
0005| steps necessary to comply with the Internal Revenue Code of
|
0006| 1986, as amended. Proceeds from the sale of the bonds are
|
0007| appropriated for the purposes specified in this act.
|
0008| B. The agencies named in this act shall certify to
|
0009| the state board of finance when the money from the proceeds of
|
0010| the severance tax bonds authorized in this section is needed
|
0011| for the purposes specified in the applicable section of this
|
0012| act.
|
0013| C. If the specified agency has not certified the
|
0014| need for the issuance of the bonds by the end of fiscal year
|
0015| 2000, the authorization provided in this act shall be void.
|
0016| D. Unless otherwise specified in this act, any
|
0017| unexpended or unencumbered balance remaining from the proceeds
|
0018| of severance tax bonds issued pursuant to this act at the end
|
0019| of fiscal year 2002 shall revert to the severance tax bonding
|
0020| fund.
|
0021| Section 2. SEVERANCE TAX BONDS--STATE AGENCY ON AGING--
|
0022| PURPOSES.--Pursuant to the provisions of Section 1 of this
|
0023| act, upon certification by the state agency on aging that the
|
0024| need exists for the issuance of the bonds, the following
|
0025| amounts are appropriated to the state agency on aging for the
|

0001| following purposes:
|
0002| A. one hundred thousand dollars ($100,000) for the
|
0003| purpose of planning, designing or constructing a senior
|
0004| citizen center for the community of Truchas located in Rio
|
0005| Arriba county; and
|
0006| B. fifty thousand dollars ($50,000) to fund phase
|
0007| three of construction of the Santa Clara senior citizen and
|
0008| community center of the pueblo of Santa Clara in Rio Arriba
|
0009| county.
|
0010| Section 3. SEVERANCE TAX BONDS--STATE ARMORY BOARD--
|
0011| PURPOSES.--Pursuant to the provisions of Section 1 of this
|
0012| act, upon certification by the state armory board that the
|
0013| need exists for the issuance of the bonds, the following
|
0014| amounts are appropriated to the state armory board for the
|
0015| following purposes:
|
0016| A. four hundred thousand dollars ($400,000) to
|
0017| plan, design and construct an armory near Clayton in Union
|
0018| county; and
|
0019| B. seven hundred forty-four thousand five hundred
|
0020| dollars ($744,500) to renovate, repair or make improvements to
|
0021| various armories located throughout the state.
|
0022| Section 4. SEVERANCE TAX BONDS--OFFICE OF CULTURAL
|
0023| AFFAIRS--PURPOSES.--Pursuant to the provisions of Section 1 of
|
0024| this act, upon certification by the office of cultural affairs
|
0025| that the need exists for the issuance of the bonds, the
|

0001| following amounts are appropriated to the office of cultural
|
0002| affairs for the following purposes:
|
0003| A. fifty thousand dollars ($50,000) for the
|
0004| purpose of planning, designing or preparing bids for a new
|
0005| museo cultural in the city of Santa Fe located in Santa Fe
|
0006| county;
|
0007| B. fifteen thousand dollars ($15,000) for the
|
0008| purpose of equipping a newly constructed library at the pueblo
|
0009| of Cochiti located in Sandoval county;
|
0010| C. one hundred twenty-five thousand dollars
|
0011| ($125,000) for the purpose of re-roofing the Clyde Tombaugh
|
0012| space theater and planetarium at the space center in
|
0013| Alamogordo located in Otero county;
|
0014| D. one hundred fifty thousand dollars ($150,000)
|
0015| for the purpose of planning or designing an addition to the
|
0016| palace of the governors state history museum located in Santa
|
0017| Fe county;
|
0018| E. one hundred thousand dollars ($100,000) for the
|
0019| purpose of installing a heating and ventilation air
|
0020| conditioning control system in the space center in Alamogordo
|
0021| located in Otero county;
|
0022| F. one hundred thousand dollars ($100,000) for the
|
0023| purpose of designing, constructing, furnishing or equipping a
|
0024| new pavilion, greenhouse and science theater at the New Mexico
|
0025| museum of natural history and science in Albuquerque located
|

0001| in Bernalillo county;
|
0002| G. five hundred thousand dollars ($500,000) to
|
0003| renovate, repair or make improvements to state museums and
|
0004| facilities located throughout the state; and
|
0005| H. one hundred thousand dollars ($100,000) to
|
0006| design, develop, construct or equip permanent exhibits at the
|
0007| New Mexico farm and ranch heritage museum in Dona Ana county.
|
0008| Section 5. SEVERANCE TAX BONDS--CUMBRES AND TOLTEC
|
0009| SCENIC RAILROAD COMMISSION--PURPOSE.--Pursuant to the
|
0010| provisions of Section 1 of this act, upon certification by the
|
0011| Cumbres and Toltec scenic railroad commission that the need
|
0012| exists for the issuance of the bonds, fifty thousand dollars
|
0013| ($50,000) is appropriated to the Cumbres and Toltec scenic
|
0014| railroad commission to renovate, in order to comply with the
|
0015| provisions of the federal Americans with Disabilities Act of
|
0016| 1990, the Chama engine house, the Osier facility or the
|
0017| Antonito depot of the Cumbres and Toltec scenic railroad
|
0018| located in Rio Arriba county.
|
0019| Section 6. SEVERANCE TAX BONDS--ECONOMIC DEVELOPMENT
|
0020| DEPARTMENT--PURPOSE.--Pursuant to the provisions of Section 1
|
0021| of this act, upon certification by the state housing authority
|
0022| of the economic development department that the need exists
|
0023| for the issuance of the bonds, one hundred thousand dollars
|
0024| ($100,000) is appropriated to the state housing authority of
|
0025| the economic development department to plan, design, construct
|

0001| or equip a child-care training center to be located within a
|
0002| one-hundred-twenty-unit affordable housing project in the city
|
0003| of Santa Fe in Santa Fe county.
|
0004| Section 7. SEVERANCE TAX BONDS--ENERGY, MINERALS AND
|
0005| NATURAL RESOURCES DEPARTMENT--PURPOSE.--Pursuant to the
|
0006| provisions of Section 1 of this act, upon certification by the
|
0007| energy, minerals and natural resources department that the
|
0008| need exists for the issuance of the bonds, five hundred
|
0009| thousand dollars ($500,000) is appropriated to the energy,
|
0010| minerals and natural resources department for the purpose of
|
0011| planning, designing, renovating and making improvements to
|
0012| forestry headquarter facilities and other facilities
|
0013| throughout the state.
|
0014| Section 8. SEVERANCE TAX BONDS--OFFICE OF THE STATE
|
0015| ENGINEER--PURPOSE.--Pursuant to the provisions of Section 1 of
|
0016| this act, upon certification by the office of the state
|
0017| engineer that the need exists for the issuance of the bonds,
|
0018| fifty thousand dollars ($50,000) is appropriated to the office
|
0019| of the state engineer for the purpose of designing,
|
0020| constructing, purchasing or installing siphons for acequias
|
0021| near Hernandez located in Rio Arriba county.
|
0022| Section 9. SEVERANCE TAX BONDS--DEPARTMENT OF
|
0023| ENVIRONMENT--PURPOSES.--Pursuant to the provisions of Section
|
0024| 1 of this act, upon certification by the department of
|
0025| environment that the need exists for the issuance of the
|

0001| bonds, the following amounts are appropriated to the
|
0002| department of environment for the following purposes:
|
0003| A. fifty thousand dollars ($50,000) for
|
0004| improvements to the Lone Mountain and Twin Sisters wellfields
|
0005| in the village of Santa Clara in Grant county;
|
0006| B. seventy-five thousand dollars ($75,000) for the
|
0007| acquisition or installation of a water tank or the
|
0008| construction or installation of approximately ten thousand
|
0009| linear feet of transmission pipeline to connect to the
|
0010| existing water system in Corona in Lincoln county;
|
0011| C. fifty thousand dollars ($50,000) for the
|
0012| purpose of surveying a well location, drilling or equipping
|
0013| wells, purchasing or replacing storage tanks and valves or for
|
0014| engineering or other studies to improve the Lincoln mutual
|
0015| domestic water and sewage association water system located in
|
0016| Lincoln county;
|
0017| D. seventy-eight thousand dollars ($78,000) for
|
0018| the purpose of making improvements to the Bibo community water
|
0019| system located in Cibola county;
|
0020| E. twenty-five thousand dollars ($25,000) for
|
0021| planning, designing, constructing or equipping a water and
|
0022| wastewater system in the town of Springer in Colfax county;
|
0023| F. twenty-five thousand dollars ($25,000) for
|
0024| improvements to the water and wastewater system, including a
|
0025| water filtration system, for the community of Miami in Colfax
|

0002| G. twenty-five thousand dollars ($25,000) for
|
0003| planning, designing, constructing or equipping improvements to
|
0004| the water and wastewater system in the village of Eagle Nest
|
0005| in Colfax county;

|
0007| planning, designing or constructing improvements to the
|
0008| domestic water system in the community of Puerto de Luna in
|
0009| Guadalupe county;
|
0010| I. twenty thousand dollars ($20,000) for various
|
0011| improvements to the wastewater system in the town of Vaughn in
|
0012| Guadalupe county;
|
0013| J. twenty thousand dollars ($20,000) for planning,
|
0014| designing, constructing or equipping a new domestic and
|
0015| wastewater system for the unincorporated community of Mora in
|
0016| Mora county;
|
0017| K. twenty-five thousand dollars ($25,000) for
|
0018| planning, designing, constructing or equipping improvements to
|
0019| various community domestic water and wastewater systems
|
0020| throughout Mora county;
|
0021| L. one hundred thousand dollars ($100,000) to
|
0022| complete the Clovis drainage project from Seventh street to
|
0023| Ingram lake in Curry county;
|
0024| M. fifty thousand dollars ($50,000) for the
|
0025| westside sewer line in Clovis in Curry county;
|

0002| purpose of making various improvements to the domestic and
|
0003| wastewater systems in the Gabaldon Hill area of the city of
|
0004| Grants located in Cibola county;
|
0005| O. one hundred thousand dollars ($100,000) for the
|
0006| purpose of designing, constructing or equipping improvements
|
0007| to, or purchasing water rights for, the water system of the
|
0008| Ponderosa mutual domestic water consumers association located
|
0009| in Sandoval county;
|
0010| P. thirty-nine thousand dollars ($39,000) to
|
0011| purchase and install a water storage tank and water lines for
|
0012| the village of Grady in Curry county;
|
0013| Q. twenty thousand dollars ($20,000) to plan,
|
0014| develop or construct a water system for the Canon mutual
|
0015| domestic water association in Taos county; and
|
0016| R. eighty thousand dollars ($80,000) to extend a
|
0017| water line on Watson lane in Dona Ana county.
|
0018| Section 10. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE
|
0019| AND ADMINISTRATION--PURPOSES.--Pursuant to the provisions of
|
0020| Section 1 of this act, upon certification by the local
|
0021| government division of the department of finance and
|
0022| administration that the need exists for the issuance of the
|
0023| bonds, the following amounts are appropriated to the local
|
0024| government division of the department of finance and
|
0025| administration for the following purposes:
|

0001| A. one hundred thousand dollars ($100,000) for the
|
0002| purpose of planning, designing or constructing a fire
|
0003| substation and multipurpose center in Alcalde located in Rio
|
0004| Arriba county;
|
0005| B. one hundred thousand dollars ($100,000) for the

0006| purpose of equipping or landscaping the new Santa Fe boys and
|
0007| girls club in the city of Santa Fe located in Santa Fe county;
|
0008| C. ten thousand dollars ($10,000) for the purpose
|
0009| of making improvements to or expanding the facility of the

0010| West Mesa little league park located north of Sequoia road and
|
0011| east of Coors boulevard on the west side of Albuquerque
|
0012| located in Bernalillo county;

0013| D. ten thousand dollars ($10,000) for the purpose

0014| of purchasing or equipping vans for transportation of senior
|
0015| citizens and others to and from the Pat Hurley Park community
|
0016| center on the west side of Albuquerque located in Bernalillo

0018| E. twenty-one thousand dollars ($21,000) for the

0019| purpose of purchasing or equipping vans for the transportation
|
0020| of senior citizens and others to and from the West Mesa
|
0021| community center in Albuquerque located in Bernalillo county;

0022| F. one hundred twenty-five thousand dollars
|
0023| ($125,000) for the purpose of planning, designing or making
|
0024| improvements, including interior remodeling, accessibility and

0025| grounds, to the former Atchison, Topeka and Santa Fe railroad

|
0006| Mexico school for the deaf for campus improvements, including
|
0007| roof repairs, completion of construction of the library and
|
0008| dormitory, for equipping the television-media studio, for
|
0009| purchasing vehicles for student transportation or for
|
0010| maintenance at New Mexico school for the deaf located in Santa
|
0011| Fe county.
|
0012| Section 25. SEVERANCE TAX BONDS--SAN JUAN COLLEGE--
|
0013| PURPOSES.--Pursuant to the provisions of Section 1 of this
|
0014| act, upon certification by the governing board of San Juan
|
0015| college that the need exists for the issuance of the bonds,
|
0016| the following amounts are appropriated to the governing board
|
0017| of San Juan college for the following purposes:
|
0018| A. one hundred thousand dollars ($100,000) for the
|
0019| purpose of campus improvements at the San Juan college west
|
0020| center in Kirtland located in San Juan county;
|
0021| B. seventy-five thousand dollars ($75,000) for the
|
0022| purpose of installing or upgrading an energy management system
|
0023| for San Juan college located in San Juan county; and

0024| C. five hundred fifty thousand dollars ($550,000)

0012| phase three continuation of the expansion and renovation of

0013| the university of New Mexico football stadium located in

0015| B. fifty thousand dollars ($50,000) to make

0011| INDIAN AFFAIRS--CHANGE IN PURPOSE--APPROPRIATION.--The balance

0012| of the proceeds from the sale of severance tax bonds

0013| appropriated to the New Mexico office of Indian affairs
|
0014| pursuant to Subsection B of Section 9 of Chapter 4 of Laws

0015| 1996 (1st S.S.) for the purpose of planning, designing or

0016| constructing a group home for disabled senior citizens at
|
0017| Tohatchi located in McKinley county shall not be expended for
|
0018| its original purpose but is reauthorized and appropriated to

0019| the New Mexico office of Indian affairs for the purpose of

0020| planning, designing or constructing a group home for disabled

0021| citizens at Tohatchi located in McKinley county.
|
0022| Section 29. SEVERANCE TAX BONDS--NEW MEXICO OFFICE OF

0023| INDIAN AFFAIRS--CHANGE IN PURPOSE--APPROPRIATION.--The balance
|
0024| of the proceeds from the sale of severance tax bonds
|
0025| appropriated to the New Mexico office of Indian affairs
|

0002| 1994 to design, plan, construct and equip a multipurpose

0003| community center at Chichiltah located in McKinley county

0006| Indian affairs for house wiring in Chichiltah in McKinley

0008| Section 30. SEVERANCE TAX BONDS--DEPARTMENT OF

0009| ENVIRONMENT--CHANGE IN PURPOSE--APPROPRIATION.--The balance of

0010| the proceeds from the sale of severance tax bonds appropriated
|
0011| to the department of environment pursuant to Subsection TT of
|
0012| Section 6 of Chapter 4 of Laws 1996 (1st S.S.) for the purpose
|
0013| of designing, constructing or inspecting a new water storage
|
0014| tank and related water system improvements in the village of
|
0015| Cerrillos located in Santa Fe county shall not be expended for
|
0016| its original purpose but is reauthorized and appropriated to
|
0017| the department of environment for the purpose of designing,
|
0018| constructing or inspecting water system improvements in the
|
0019| village of Cerrillos located in Santa Fe county.
|
0020| Section 31. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE
|
0021| AND ADMINISTRATION--EXTENDING EXPENDITURE PERIOD--
|
0022| APPROPRIATION.--The period of time in which the proceeds from
|
0023| the sale of severance tax bonds appropriated to the local
|
0024| government division of the department of finance and
|
0025| administration to construct a year-round multipurpose
|

|
0002| located in Dona Ana county pursuant to Subsections II and
|
0003| GGGGG of Section 9 of Chapter 148 of Laws 1994 may be expended

0005| unencumbered balance remaining at the end of fiscal year 2002
|
0006| shall revert to the severance tax bonding fund.
|
0007| Section 32. GENERAL FUND--DEPARTMENT OF FINANCE AND

0008| ADMINISTRATION--EXPANSION OF PURPOSE--REAPPROPRIATION OF
|
0009| BALANCES.--Nineteen thousand five hundred thirty-four dollars
|
0010| ($19,534) remaining of the proceeds of the general fund
|
0011| appropriation pursuant to Paragraph (30) of Subsection B of
|
0012| Section 49 of Chapter 148 of Laws 1994 to acquire land for a
|
0013| community fire station in Chamisal in Taos county is
|
0014| reappropriated to the local government division of the
|
0015| department of finance and administration to plan, design,
|
0016| construct and equip the Chamisal fire substation.

0017| Section 33. SEVERANCE TAX BONDS--CHANGE IN AGENCY--
|
0018| CHANGE IN PURPOSE--APPROPRIATION.--The balance of the proceeds
|
0019| from the sale of severance tax bonds appropriated to the
|
0020| corrections department to begin planning, design and
|
0021| construction of a child visitation facility at the women's
|
0022| correctional institution in Cibola county pursuant to Laws
|
0023| 1994, Chapter 148, Section 39 shall not be expended for its
|
0024| original purpose but is reauthorized and appropriated to the
|
0025| local government division of the department of finance and
|

0002| Albuquerque in Bernalillo county for women in the criminal
|
0003| justice system who are on reintegration or diversion status.

0004| Section 34. SEVERANCE TAX BONDS--CHANGE IN AGENCY--

0005| CHANGE IN PURPOSE--APPROPRIATION.--The balance of the proceeds
|
0006| from the sale of severance tax bonds appropriated to the
|
0007| property control division of the general services department
|
0008| for the purpose of planning, designing or constructing an all-
|
0009| purpose overnight family visitation center for children and
|
0010| their inmate mothers at the New Mexico women's correctional
|
0011| facility in Grants in Cibola county pursuant to Subsection A
|
0012| of Section 7 of Chapter 4 of Laws 1996 (1st S.S.) shall not be
|
0013| expended for its original purpose but is reauthorized and
|
0014| appropriated to the local government division of the
|
0015| department of finance and administration to construct a
|
0016| transitional living facility in Albuquerque in Bernalillo
|
0017| county for women in the criminal justice system who are on
|
0018| reintegration or diversion status.
|
0019| Section 35. SEVERANCE TAX BONDS--STATE DEPARTMENT OF
|
0020| PUBLIC EDUCATION--CHANGE IN PURPOSE--APPROPRIATION.--The
|
0021| balance of the proceeds from the sale of severance tax bonds
|
0022| appropriated to the state department of public education
|
0023| pursuant to Subsection V of Section 12 of Chapter 4 of Laws
|
0024| 1996 (1st S.S.) for the purpose of purchasing or installing
|
0025| computer technology at St. Catherine Indian school in Santa Fe
|

0002| original purpose but is reauthorized and appropriated to the

0003| state department of public education for the purpose of

|
0007| St. Catherine Indian school located in Santa Fe in Santa Fe
|
0008| county.

0009| Section 36. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE
|
0010| AND ADMINISTRATION--CHANGE IN PURPOSE--APPROPRIATION.--The
|
0011| balance of the proceeds from the sale of severance tax bonds
|
0012| appropriated to the local government division of the
|
0013| department of finance and administration pursuant to
|
0014| Subsection G of Section 5 of Chapter 4 of Laws 1996 (1st S.S.)
|
0015| for the purpose of improving or updating equipment for the
|
0016| Moriarty fire department located in Torrance county shall not
|
0017| be expended for its original purpose but is reauthorized and
|
0018| appropriated to the local government division of the
|
0019| department of finance and administration for the purpose of
|
0020| improving or updating equipment for the fire department
|
0021| located in northeast Torrance county.
|
0022| Section 37. SEVERANCE TAX BONDS--CAPITAL PROGRAM FUND--
|
0023| EXTENDING EXPENDITURE PERIOD--CHANGE IN PURPOSE--
|
0024| APPROPRIATION.--Notwithstanding the provisions of Subsection D
|
0025| of Section 1 of Chapter 148 of Laws 1994, the balance of the
|

0001| proceeds from the sale of severance tax bonds appropriated to
|
0002| the general services department pursuant to Subsection C of
|
0003| Section 13 of Chapter 148 of Laws 1994 to plan and design a

0004| facility to replace Meadows hospital in Las Vegas located in

0005| San Miguel county shall not be expended for its original
|
0006| purpose but is reauthorized and appropriated to the capital
|
0007| program fund to plan, design, renovate and make improvements
|
0008| to state buildings located throughout the state. The period
|
0009| of time in which this appropriation may be expended shall be
|
0010| extended through fiscal year 2002. Any unexpended or
|
0011| unencumbered balance remaining from the proceeds of the bonds
|
0012| at the end of fiscal year 2002 shall revert to the severance
|
0013| tax bonding fund.
|
0014| Section 38. SEVERANCE TAX BONDS--CAPITAL PROGRAM FUND--
|
0015| EXTENDING EXPENDITURE PERIOD--CHANGE IN PURPOSE--
|
0016| REAUTHORIZATION.--Notwithstanding the provisions of Subsection
|
0017| D of Section 1 of Chapter 148 of Laws 1994, the balance of the
|
0018| proceeds from the sale of severance tax bonds appropriated to
|
0019| the general services department pursuant to Subsection D of
|
0020| Section 13 of Chapter 148 of Laws 1994 to construct, furnish
|
0021| and equip a visitor, control and administrative center and
|
0022| improve security at the New Mexico boys' school at Springer
|
0023| located in Colfax county shall not be expended for its
|
0024| original purpose but is reauthorized and appropriated to the
|
0025| capital program fund to repair, renovate and make improvements
|

0002| county. The period of time in which this appropriation may be
|
0003| expended shall be extended through fiscal year 2002. Any

0004| unexpended or unencumbered balance remaining from the proceeds

0005| of the bonds at the end of fiscal year 2002 shall revert to
|
0006| the severance tax bonding fund.
|
0007| Section 39. NEW MEXICO FINANCE AUTHORITY REVENUE BONDS--
|
0008| GENERAL SERVICES DEPARTMENT--EXPANSION OF PURPOSE.--
|
0009| Notwithstanding the provisions of Laws 1994, Chapter 91,
|
0010| Section 1, the purpose of the appropriation from the sale of
|
0011| New Mexico finance authority revenue bonds to the property
|
0012| control division of the general services department made
|
0013| pursuant to Subsection A of Section 73 of Chapter 367 of Laws
|
0014| 1993 is expanded to include constructing, equipping and
|
0015| furnishing a state office building for the workers'
|
0016| compensation administration in Albuquerque.
|
0017| Section 40. STATE ROAD FUND--CHANGE IN PURPOSE--
|
0018| APPROPRIATION.--The balance of the appropriation from the
|
0019| state road fund to the state highway and transportation
|
0020| department for the purpose of installing salt storage domes at
|
0021| patrol yards in Taos located in Taos county, in Chama located
|
0022| in Rio Arriba county and in Santa Fe located in Santa Fe
|
0023| county pursuant to Laws 1996 (1st S.S.), Chapter 4, Section 40
|
0024| shall not be expended for its original purpose but is
|
0025| appropriated to the state highway and transportation
|

0003| Section 41. SEVERANCE TAX BONDS--CAPITAL PROGRAM FUND--

0005| REAUTHORIZATION.--Notwithstanding the provisions of Subsection

0006| D of Section 1 of Chapter 113 of Laws 1992, the balance of the

0007| proceeds from the sale of severance tax bonds appropriated to
|
0008| the property control division of the general services
|
0009| department pursuant to Subsection V of Section 18 of that
|
0010| chapter to reroof the southern New Mexico correctional
|
0011| facility in Dona Ana county shall not be expended for its
|
0012| original purpose but is reauthorized and appropriated to the
|
0013| capital program fund to plan, design, renovate and make
|
0014| improvements to the education building to convert for use as a
|
0015| mental health, reception and diagnostic center at the central
|
0016| New Mexico correctional facility located in Valencia county.

0017| The period of time in which this appropriation may be expended
|
0018| shall be extended through fiscal year 2002. Any unexpended or
|
0019| unencumbered balance remaining from the proceeds of the bonds
|
0020| at the end of fiscal year 2002 shall revert to the severance
|
0021| tax bonding fund.

0022| Section 42. SEVERANCE TAX BONDS--CAPITAL PROGRAM FUND--

0023| EXTENDING EXPENDITURE PERIOD--CHANGE IN PURPOSE--

0024| REAUTHORIZATION.--The balance of the proceeds from the sale of

0025| severance tax bonds appropriated to the general services

0001| 1996 shall not be expended for those original purposes but is

0002| reauthorized and appropriated to the capital program fund to
|
0003| plan, design, construct or make improvements to the education
|
0004| building to convert for use as a mental health, reception and
|
0005| diagnostic center at the central New Mexico correctional
|
0006| facility located in Valencia county. The period of time in
|
0007| which this appropriation may be expended shall be extended
|
0008| through fiscal year 2002. Any unexpended or unencumbered
|
0009| balance remaining from the proceeds of the bonds at the end of
|
0010| fiscal year 2002 shall revert to the severance tax bonding
|
0011| fund.
|
0012| Section 44. PROJECT SCOPE--EXPENDITURES.--If an
|
0013| appropriation for a project authorized in this act is not
|
0014| sufficient to complete all the purposes specified, the
|
0015| appropriation may be expended for any portion of the purposes
|
0016| specified in the appropriation. Expenditures shall not be
|
0017| made for purposes other than those specified in the
|
0018| appropriation.
|
0019| Section 45. ART IN PUBLIC PLACES.--Pursuant to Section
|
0020| 13-4A-4 NMSA 1978 and where applicable, the appropriations
|
0021| authorized in this act include one percent for the art in
|
0022| public places fund.
|
0023| Section 46. EMERGENCY.--It is necessary for the public
|
0024| peace, health and safety that this act take effect immediately.
|
