0011| RELATING TO MUNICIPAL COURTS; INCREASING THE AMOUNT OF THE

0012| COURT AUTOMATION FEE ASSESSED AND COLLECTED BY THE MUNICIPAL
|
0013| COURTS; MAKING AN APPROPRIATION; AMENDING A SECTION OF THE
|
0014| NMSA 1978; REPEALING LAWS 1994, CHAPTER 69, SECTION 2.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 35-14-11 NMSA 1978 (being Laws 1983,
|
0018| Chapter 134, Section 6, as amended) is amended to read:
|
0019| "35-14-11. MUNICIPAL ORDINANCE--COURT COSTS--
|
0020| COLLECTION--PURPOSE.--
|
0021| A. Every municipality shall enact an ordinance
|
0022| requiring assessment of corrections fees, judicial education
|
0023| fees and court automation fees to be collected as court costs
|
0024| and used as provided in this section.
|
0025| B. As used in this subsection, "convicted" means
|

0001| the defendant has been found guilty of a criminal charge by a
|
0002| municipal judge, either after trial, a plea of guilty or a
|
0003| plea of nolo contendere. A municipal judge shall collect the
|
0004| following costs:
|
0005| (1) a corrections fee of ten dollars
|
0006| ($10.00);
|
0007| (2) a judicial education fee of one dollar
|
0008| ($1.00); and
|
0009| (3) a court automation fee of [three dollars
|
0010| ($3.00)] ten dollars ($10.00).
|
0011| C. The fees are to be collected upon conviction
|
0012| from persons convicted of violating any ordinance relating to
|
0013| the operation of a motor vehicle or any ordinance that may be
|
0014| enforced by the imposition of a term of imprisonment.
|
0015| D. All money collected pursuant to Paragraph (1)
|
0016| of Subsection B of this section shall be deposited in a
|
0017| special fund in the municipal treasury and shall be used for
|
0018| municipal jailer or juvenile detention officer training, for
|
0019| the construction planning, construction, operation and
|
0020| maintenance of a municipal jail or juvenile detention
|
0021| facility, for paying the cost of housing municipal prisoners
|
0022| in a county jail or housing juveniles in a detention facility
|
0023| or for complying with match or contribution requirements for
|
0024| the receipt of federal funds relating to jails or juvenile
|
0025| detention facilities.

0001| E. All money collected pursuant to Paragraph (2)
|
0002| of Subsection B of this section shall be remitted monthly to
|
0003| the state treasurer for credit to the judicial education fund
|
0004| and shall be used for the education and training, including
|
0005| production of bench books and other written materials, of
|
0006| municipal judges and other municipal court employees.
|
0007| F. All money collected pursuant to Paragraph (3)
|
0008| of Subsection B of this section shall be remitted monthly to
|
0009| the state treasurer for credit to the municipal court
|
0010| automation fund and shall be used for the purchase and
|
0011| maintenance of court automation systems in the municipal
|
0012| courts. The court automation systems shall have the
|
0013| capability of providing, on a timely basis, electronic records
|
0014| in a format specified by the judicial information system
|
0015| council."
|
0016| Section 2. REPEAL.--Laws 1994, Chapter 69, Section 2 is
|
0017| repealed.
|
0018| Section 3. EFFECTIVE DATE.--The effective date of the
|
0019| provisions of this act is July 1, 1998.
