0011| RELATING TO COURTS; CREATING ADDITIONAL JUDGESHIPS IN THE

0012| BERNALILLO COUNTY METROPOLITAN COURT; CREATING ADDITIONAL
|
0013| JUDGESHIPS IN THE MAGISTRATE COURTS; AMENDING SECTIONS OF THE
|
0014| NMSA 1978; MAKING APPROPRIATIONS.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 34-8A-8 NMSA 1978 (being Laws 1979,
|
0018| Chapter 346, Section 8, as amended) is amended to read:
|
0019| "34-8A-8. METROPOLITAN COURT--BERNALILLO DISTRICT.--
|
0020| A. The name of the metropolitan court in the
|
0021| Bernalillo metropolitan district shall be the "Bernalillo
|
0022| county metropolitan court".
|
0023| B. The metropolitan court is an agency of the
|
0024| judicial department of state government. Personnel of the
|
0025| metropolitan court are subject to all laws and regulations
|

0001| applicable to state officers and agencies and state officers
|
0002| and employees, except where otherwise specifically provided by
|
0003| law.
|
0004| C. There shall be nineteen judges of the
|
0005| Bernalillo county metropolitan court."
|
0006| Section 2. Section 35-1-6 NMSA 1978 (being Laws 1968,
|
0007| Chapter 62, Section 8, as amended) is amended to read:
|
0008| "35-l-6. MAGISTRATE COURT--CHAVES DISTRICT.--There shall
|
0009| be [two] three magistrates in Chaves magistrate district,
|
0010| divisions 1, [and] 2 and 3 operating as a single court in
|
0011| Roswell."
|
0012| Section 3. Section 35-1-10 NMSA 1978 (being Laws 1968,
|
0013| Chapter 62, Section 12, as amended) is amended to read:
|
0014| "35-1-10. MAGISTRATE COURT--DONA ANA DISTRICT.--There
|
0015| shall be [three] five magistrates in Dona Ana magistrate
|
0016| district, divisions 1, 2, [and] 3 and 4 operating as a
|
0017| single court in Las Cruces [The magistrates shall rotate
|
0018| riding circuit to Anthony and Hatch on a regularly scheduled
|
0019| basis] and division 5 in Anthony. The division 1, 2, 3 and
|
0020| 4 magistrates shall rotate riding circuit to Hatch on a
|
0021| regularly scheduled basis."

0022| Section 4. Section 35-1-26 NMSA 1978 (being Laws 1968,
|
0023| Chapter 62, Section 28) is amended to read:
|
0024| "35-1-26. MAGISTRATE COURT--SANDOVAL DISTRICT.--There
|
0025| shall be [two] three magistrates in Sandoval magistrate
|

0001| district, [division 1] divisions 1 and 3 in Bernalillo and
|
0002| division 2 in Cuba."
|
0003| Section 5. Section 35-1-27 NMSA 1978 (being Laws 1968,
|
0004| Chapter 62, Section 29, as amended) is amended to read:
|
0005| "35-l-27. MAGISTRATE COURT--SAN JUAN DISTRICT.--There
|
0006| shall be [three] four magistrates in San Juan magistrate
|
0007| district, division 1 in Aztec and divisions 2, [and] 3 and
|
0008| 4 operating as a single court in Farmington. The division 4
|
0009| magistrate shall ride circuit to Aztec as needed."
|
0010| Section 6. Section 35-1-29 NMSA 1978 (being Laws 1968,
|
0011| Chapter 62, Section 31, as amended) is amended to read:
|
0012| "35-1-29. MAGISTRATE COURT--SANTA FE DISTRICT.--There
|
0013| shall be [three] four magistrates in Santa Fe magistrate
|
0014| district, divisions 1, 2, [and] 3 and 4 operating as a
|
0015| single court in Santa Fe. [however] One magistrate shall
|
0016| ride circuit to Pojoaque on a regularly scheduled basis."
|
0017| Section 7. TEMPORARY PROVISION--BERNALILLO COUNTY
|
0018| METROPOLITAN COURT--ELECTION--DRUG COURT--TRAFFIC COURT.--
|
0019| A. The additional judges provided for the
|
0020| Bernalillo county metropolitan court in this act shall be
|
0021| appointed by the governor pursuant to Article 6 of the
|
0022| constitution of New Mexico, and the term of office for those
|
0023| judges shall begin on January 1, 1999.
|
0024| B. Two of the additional judges provided for the
|
0025| Bernalillo county metropolitan court in this act shall preside
|

0001| over the operation of drug courts.
|
0002| C. Two of the additional judges provided for the
|
0003| Bernalillo county metropolitan court in this act shall preside
|
0004| over the operation of traffic courts.
|
0005| Section 8. TEMPORARY PROVISION--MAGISTRATES--ELECTION.--
|
0006| The additional magistrate judges provided for in this act
|
0007| shall be appointed by the governor, and the term of office for
|
0008| those magistrate judges shall begin on January 1, 1999.
|
0009| Section 9. APPROPRIATIONS.--
|
0010| A. The following amounts are appropriated from the
|
0011| general fund to the following entities for expenditure in
|
0012| fiscal year 1999 for the specified purposes:
|
0013| (1) four hundred ninety-one thousand five
|
0014| hundred sixteen dollars ($491,516) to the Bernalillo county
|
0015| metropolitan court for the purpose of paying salaries and
|
0016| benefits and providing furniture, equipment and supplies for
|
0017| four judges and support staff;
|
0018| (2) forty-two thousand two hundred twenty-
|
0019| eight dollars ($42,228) to the administrative office of the
|
0020| courts for the purpose of paying salaries and benefits and
|
0021| providing furniture, equipment and supplies for one magistrate
|
0022| judge in the Chaves magistrate district;
|
0023| (3) eighty-four thousand four hundred fifty-
|
0024| six dollars ($84,456) to the administrative office of the
|
0025| courts for the purpose of paying salaries and benefits and
|

0001| providing furniture, equipment and supplies for two magistrate
|
0002| judges in the Dona Ana magistrate district;
|
0003| (4) forty-two thousand two hundred twenty-
|
0004| eight dollars ($42,228) to the administrative office of the
|
0005| courts for the purpose of paying salaries and benefits and
|
0006| providing furniture, equipment and supplies for one magistrate
|
0007| judge in the Sandoval magistrate district;
|
0008| (5) forty-two thousand two hundred twenty-
|
0009| eight dollars ($42,228) to the administrative office of the
|
0010| courts for the purpose of paying salaries and benefits and
|
0011| providing furniture, equipment and supplies for one magistrate
|
0012| judge in the San Juan magistrate district; and
|
0013| (6) forty-two thousand two hundred twenty-
|
0014| eight dollars ($42,228) to the administrative office of the
|
0015| courts for the purpose of paying salaries and benefits and
|
0016| providing furniture, equipment and supplies for one magistrate
|
0017| judge in the Santa Fe magistrate district.
|
0018| B. Any unexpended or unencumbered balance
|
0019| remaining at the end of fiscal year 1999 shall revert to the
|
0020| general fund.
|
0021| Section 10. EFFECTIVE DATE.--The effective date of the
|
0022| provisions of this act is January 1, 1999.
