0011| RELATING TO DISTRICT ATTORNEYS; CREATING THE DISTRICT ATTORNEY

0012| FUND; MAKING AN APPROPRIATION; DECLARING AN EMERGENCY.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0015| Section 1. DISTRICT ATTORNEY FUND--CREATED--
|
0016| ADMINISTRATION--PURPOSE.--
|
0017| A. The "district attorney fund" is created in the
|
0018| state treasury. The fund shall consist of worthless check
|
0019| fees, preprosecution diversion fees, other statutory revenues
|
0020| directed to the fund, appropriations, gifts, grants and
|
0021| donations.
|
0022| B. Money in the fund is appropriated to the
|
0023| administrative office of the district attorneys for the sole
|
0024| purpose of meeting necessary expenses incurred in the
|
0025| operation of the administrative office of the district
|

0001| attorneys.

0002| C. Expenditures from the fund shall be pursuant to
|
0003| budgets approved by the state budget division of the
|
0004| department of finance and administration and made by warrant
|
0005| drawn by the secretary of finance and administration pursuant
|
0006| to vouchers signed by the director of the administrative
|
0007| office of the district attorneys or his authorized
|
0008| representative.
|
0009| D. The fund shall not revert at the end of any
|
0010| fiscal year.
|
0011| Section 2. EMERGENCY.--It is necessary for the public
|
0012| peace, health and safety that this act take effect
|
0013| immediately.
