0011| RECOGNIZING THE NEED TO IMPLEMENT THE 1995 REFORMS TO THE NEW
|
0012| MEXICO SUBDIVISION ACT BEFORE MAKING ANY FURTHER REVISIONS TO
|
0013| THAT ACT AND URGING THE NEW MEXICO ASSOCIATION OF COUNTIES TO
|
0014| REPORT ITS FINDINGS ABOUT THE REFORMS TO THE FIRST SESSION OF
|
0015| THE FORTY-FOURTH LEGISLATURE ALONG WITH ANY RECOMMENDATIONS.
|

|
0017| WHEREAS, the first session of the forty-second
|
0018| legislature, after extensive debate, passed major reforms to
|
0019| the New Mexico Subdivision Act, which included stopping the
|
0020| spread of colonias, closing the four-lot split loophole and
|
0021| providing county commissioners greater authority to regulate
|
0022| subdivisions in their respective communities; and
|
0023| WHEREAS, the New Mexico association of counties organized
|
0024| a task force that drafted model county subdivision regulations
|
0025| to assist counties in the preparation of their own subdivision
|
0001| ordinances; and
|
0002| WHEREAS, the 1995 reforms required the Bernalillo, Dona
|
0003| Ana and Santa Fe county commissions to adopt new subdivision
|
0004| ordinances by July 1, 1996 and the remaining thirty counties to
|
0005| adopt new subdivision ordinances by July 1, 1997; and
|
0006| WHEREAS, Bernalillo, Dona Ana and Santa Fe counties have
|
0007| now adopted new subdivision ordinances, and Mora, San Miguel
|
0008| and Torrance counties have passed new subdivision ordinances
|
0009| ahead of schedule; and
|
0010| WHEREAS, the experience of the counties that have adopted
|
0011| new ordinances has been extremely positive, but most counties
|
0012| have not had any experience with new subdivision ordinances
|
0013| because the law does not require them to adopt them until July
|
0014| 1, 1997; and
|
0015| WHEREAS, by January 1999, every county commission will
|
0016| have had at least eighteen months of experience with new
|
0017| subdivision ordinances as part of implementing the 1995 New
|
0018| Mexico Subdivision Act reforms;
|
0019| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0020| STATE OF NEW MEXICO that appreciation be expressed to New
|
0021| Mexico's county commissioners and their staffs, to the New
|
0022| Mexico association of counties, to Attorney General Tom Udall
|
0023| and his staff and to the New Mexico homebuilders association
|
0024| for their good work in implementing the 1995 subdivision
|
0025| reforms and encouragement for their future efforts in that
|
0001| endeavor; and
|
0002| BE IT FURTHER RESOLVED that the legislature urge the New
|
0003| Mexico association of counties to submit a brief report to the
|
0004| first session of the forty-fourth legislature in January 1999,
|
0005| after informally polling all commissioners, county managers and
|
0006| county attorneys about the 1995 reforms and the new subdivision
|
0007| ordinances and provide any recommended legislative changes to
|
0008| the New Mexico Subdivision Act; and
|
0009| BE IT FURTHER RESOLVED that in the meantime the
|
0010| legislature urge the public and other affected parties, such as
|
0011| the New Mexico homebuilders association, to continue to
|
0012| cooperate and assist the county commissioners in successfully
|
0013| implementing new subdivision ordinances in each New Mexico
|
0014| county; and
|
0015| BE IT FURTHER RESOLVED that a copy of this memorial be
|
0016| submitted to Governor Gary Johnson, Lieutenant Governor Walter
|
0017| Bradley, Attorney General Tom Udall, every county commissioner
|
0018| in New Mexico and the New Mexico homebuilders association.
