0011| REQUESTING THAT THE REVENUE STABILIZATION AND TAX POLICY
|
0012| COMMITTEE STUDY MATTERS RELATED TO REGULATION OF
|
0013| TELECOMMUNICATIONS IN NEW MEXICO AND REPORT ITS FINDINGS AND
|
0014| RECOMMENDATIONS TO THE SECOND SESSION OF THE FORTY-THIRD
|
0015| LEGISLATURE.

0017| WHEREAS, the federal Telecommunications Act of 1996
|
0018| establishes new standards governing this nation's
|
0019| telecommunications industry and will open all segments of the
|
0020| industry to competition; and
|
0021| WHEREAS, the federal Telecommunications Act of 1996
|
0022| requires that state regulation of telecommunications companies
|
0023| or services be consistent with that federal act; and
|
0024| WHEREAS, the state corporation commission has conducted
|
0025| numerous public forums, formal hearings and studies and has
|
0001| promulgated new rules consistent with the federal act,
|
0002| including issuing competitive certificates to new entrants into
|
0003| New Mexico telecommunications markets; and
|
0004| WHEREAS, pursuant to approval of Constitutional Amendment
|
0005| 6 by the electorate of New Mexico at the 1996 general election,
|
0006| the state corporation commission and the New Mexico public
|
0007| utility commission are to be merged into a new public
|
0008| regulation commission, and this means that new
|
0009| telecommunications laws may need to be enacted; and
|
0010| WHEREAS, these major changes in regulation of
|
0011| telecommunications mean the legislature is faced with complex
|
0012| regulatory issues that must be addressed and understood if
|
0013| legislation that is in the best interest of New Mexicans is to
|
0014| be crafted and enacted into law;
|
0015| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0016| STATE OF NEW MEXICO that it request that the New Mexico
|
0017| legislative council direct the revenue stabilization and tax
|
0018| policy committee to study matters dealing with regulation of
|
0019| the telecommunications industry and the regulatory authority
|
0020| governing that industry in New Mexico; and
|
0021| BE IT FURTHER RESOLVED that the revenue stabilization and
|
0022| tax policy committee coordinate its study with any other
|
0023| legislative interim committee or task force that has been
|
0024| directed to study similar public regulatory issues; and
|
0025| BE IT FURTHER RESOLVED that the revenue stabilization and
|
0001| tax policy committee report its findings and recommendations,
|
0002| including any proposed legislation, to the second session of
|
0003| the forty-third legislature; and
|
0004| BE IT FURTHER RESOLVED that copies of this memorial be
|
0005| given to the speaker of the house of representatives, the
|
0006| president pro tempore of the senate and each member of the
|
0007| state corporation commission.
