0011| REQUESTING THE SUPERINTENDENT OF INSURANCE TO STUDY AND REPORT
|
0012| ON A CENTRALIZED MOTOR VEHICLE FINANCIAL RESPONSIBILITY
|
0013| INSURANCE SYSTEM.
|

|
0015| WHEREAS, New Mexico owners and drivers of motor vehicles
|
0016| are currently required to maintain valid evidence of financial
|
0017| responsibility, which is most commonly done through liability
|
0018| insurance coverage; and
|
0019| WHEREAS, many New Mexico owners and drivers fail to
|
0020| maintain the minimum required insurance coverage or other
|
0021| evidence of financial responsibility, with resultant hardship
|
0022| to persons injured through their fault; and
|
0023| WHEREAS, more than one hundred insurers are authorized to
|
0024| issue motor vehicle liability insurance in New Mexico, making
|
0025| it impossible to assure that all persons are maintaining valid
|
0001| insurance; and
|
0002| WHEREAS, it is unknown how many New Mexico owners and
|
0003| drivers are uninsured, but estimates range as high as sixty
|
0004| percent; and
|
0005| WHEREAS, some New Mexico owners and drivers cannot afford
|
0006| the full cost of even the minimum required insurance coverage;
|
0007| and
|
0008| WHEREAS, a centralized insurance system providing minimum
|
0009| limits of liability coverage paid for annually as part of motor
|
0010| vehicle registration could realize substantial cost savings and
|
0011| assure that all New Mexico drivers are covered;
|
0012| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0013| STATE OF NEW MEXICO that the superintendent of insurance be
|
0014| requested to study and make recommendations by November 1, 1997
|
0015| to the second session of the forty-third legislature concerning
|
0016| the establishment of a centralized motor vehicle insurance
|
0017| company to write liability insurance in minimum financial
|
0018| responsibility liability limits on all registered motor
|
0019| vehicles in the state, paid for as part of registration fees;
|
0020| and as part of such study to consider various forms of central
|
0021| insurer organization and financing, various financial
|
0022| responsibility limits, a low-income pool to subsidize cost to
|
0023| low-income owners and drivers, the interface with and impact
|
0024| upon the motor vehicle insurance industry in the state, various
|
0025| cost-saving methods, estimated cost savings, the appropriate
|
0001| system for collection and administration of the additional
|
0002| registration fee, exemption or non-exemption of commercial
|
0003| vehicles and all other relevant matters; and
|
0004| BE IT FURTHER RESOLVED that a copy of this memorial be
|
0005| transmitted to the superintendent of insurance.
