0011| SUPPORTING THE GUADALUPE-HIDALGO TREATY LAND CLAIMS ACT OF 1997

0012| AND ENCOURAGING THE NEW MEXICO CONGRESSIONAL DELEGATION TO TAKE
|
0013| ALL NECESSARY ACTION TO ENSURE ITS ENACTMENT.

0015| WHEREAS, the Treaty of Guadalupe-Hidalgo was signed by the
|
0016| United States of America and the Mexican Republic on February
|
0017| 2, 1848; and
|
0018| WHEREAS, the official name of the Treaty of Guadalupe-
|
0019| Hidalgo is the Treaty of Peace, Friendship, Limits and
|
0020| Settlement between the United States and the Mexican Republic;
|
0021| and
|
0022| WHEREAS, the government of the Mexican Republic ceded to
|
0023| the United States the territory that became the states of
|
0024| Arizona, California, New Mexico, Nevada, Utah and part of the
|
0025| state of Colorado; and
|
0001| WHEREAS, the Treaty of Guadalupe-Hidalgo guarantees owners
|
0002| of property and their heirs rights of ownership; and
|
0003| WHEREAS, provisions of the Treaty have not yet been fully
|
0004| implemented; and
|
0005| WHEREAS, serious questions remain unresolved regarding the
|
0006| prior ownership of lands in the state of New Mexico, especially
|
0007| public lands; and
|
0008| WHEREAS, the Guadalupe-Hidalgo Treaty Land Claims Act of
|
0009| 1997, introduced in the United States House of Representatives
|
0010| as H.R. 260, would establish the Guadalupe-Hidalgo Treaty Land
|
0011| Claims Commission which will hear and resolve land claims
|
0012| brought by the heirs and descendants of Mexican citizens living
|
0013| in the territories ceded to the United States; and
|
0014| WHEREAS, any ten or more eligible descendants who are also
|
0015| heirs to the same community land grant may file with the
|
0016| commission a petition on behalf of themselves and all other
|
0017| heirs to that land grant seeking a determination of the
|
0018| validity of the land claim on which the petition is based; and
|
0019| WHEREAS, the Guadalupe-Hidalgo Treaty Land Claims Act of
|
0020| 1997 shall establish a Community Land Grant Study Center to be
|
0021| located in Velarde, New Mexico at the Onate center to assist in
|
0022| researching the historic basis of each petition filed with the
|
0023| commission;
|
0024| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0025| STATE NEW MEXICO that the New Mexico congressional delegation
|
0001| be hereby requested to support the Guadalupe-Hidalgo Treaty
|
0002| Land Claims Act of 1997, H.R. 260, and to take all necessary
|
0003| action to assure adoption and enactment of that act by the
|
0004| 105th Congress and the President; and
|
0005| BE IT FURTHER RESOLVED, that copies of this memorial be
|
0006| transmitted to the President of the United States, the New
|
0007| Mexico congressional delegation and to the Onate center in
|
0008| Velarde, New Mexico.
