0011| RELATING TO LAW ENFORCEMENT; ESTABLISHING CERTAIN PROCEDURES

0012| FOR OPERATIONS CONDUCTED BY SPECIAL WEAPONS AND TACTICAL UNITS.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. SPECIAL WEAPONS AND TACTICAL UNITS--UNIFORMS.-
|
0016| -
|
0017| A. A law enforcement officer who participates in
|
0018| operations conducted by special weapons and tactical units
|
0019| shall wear a standard service uniform with standard
|
0020| identification or a special raid uniform that clearly
|
0021| identifies the officer's affiliation with a local, state or
|
0022| federal law enforcement agency and the officer's badge number.
|
0023| A special raid uniform shall identify the officer's affiliation
|
0024| and badge number on the front and back of the uniform in
|
0025| letters and numbers that are not smaller than five inches in
|
0001| height and that are light reflecting.
|
0002| B. A law enforcement officer who participates in
|
0003| operations conducted by special weapons and tactical units
|
0004| shall not wear ski masks, hoods or other apparel that conceal
|
0005| facial features.
|
0006| C. If bullet-proof vests or other outer garments
|
0007| are worn by a law enforcement officer who participates in
|
0008| operations conducted by special weapons and tactical units, the
|
0009| vest or outer garment shall identify the officer's affiliation
|
0010| and badge number on the front and back of the vest or garment
|
0011| in letters and numbers that are not smaller than five inches in
|
0012| height and that are light reflecting.
|
0013| Section 2. EFFECTIVE DATE.--The effective date of the
|
0014| provisions of this act is July 1, 1997.

0004| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0005| Section 1. SPECIAL WEAPONS AND TACTICAL UNITS--UNIFORMS.-
|

0007| A. A law enforcement officer who participates in
|
0008| operations conducted by special weapons and tactical units
|
0009| shall wear a standard service uniform with standard
|
0010| identification or a special raid uniform that clearly
|
0011| identifies the officer's affiliation with a local or state law
|
0012| enforcement agency. A special raid uniform shall identify the
|
0013| officer's affiliation on the front outermost layer of the
|
0014| uniform in letters that are not smaller than five inches in
|
0015| height.
|
0016| B. A law enforcement officer who participates in
|
0017| operations conducted by special weapons and tactical units may
|
0018| wear a ski mask, hood or any other apparel that conceals his
|
0019| facial features when tear gas, diversion devices or diversion
|
0020| tactics might be used during an operation.
|
0021| C. The provisions of this section shall not be
|
0022| interpreted to limit a law enforcement officer's discretion to
|
0023| use camouflage clothing or any other apparel as a tactic to
|
0024| make an entry or make an arrest when there are circumstances
|
0025| attendant to the entry or arrest that place the officer's life
|
0001| at risk.
|
0002| D. A law enforcement officer who is attached to or
|
0003| affiliated with a special weapons and tactical unit shall
|
0004| acquire forty hours of tactical training each fiscal year. A
|
0005| law enforcement officer shall not participate in any operations
|
0006| conducted by a special weapons or tactical unit if he has not
|
0007| acquired the required amount of tactical training in any fiscal
|
0008| year.
|
0009| Section 2. EFFECTIVE DATE.--The effective date of the
|
0010| provisions of this act is July 1, 1997.
