0011|     RELATING TO MUNICIPALITIES; CLARIFYING CERTAIN AUTHORITY OF THE

0012|     MAYOR IN A MAYOR-COUNCIL FORM OF MUNICIPAL GOVERNMENT.

0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  Section 3-13-3 NMSA 1978 (being Laws 1965,
    |
0016|     Chapter 300, Section 14-12-3, as amended) is amended to read:
    |
0017|          "3-13-3.  APPOINTMENT OF PROFESSIONAL ADMINISTRATOR--
    |
0018|     DUTIES AND QUALIFICATIONS.--
    |
0019|               A.  The governing body of any municipality having a
    |
0020|     population of one thousand or more persons may provide <s>[for a
</s>    |
<s></s>0021| <s>    manager either by ordinance or by an election to be called by
</s>    |
<s></s>0022| <s>    the governing body upon the filing of a petition containing the
</s>    |
<s></s>0023| <s>    signatures of at least ten percent of the registered voters in
</s>    |
<s></s>0024| <s>    the municipality.  The office of manager shall carry the same
</s>    |
<s></s>0025| <s>    qualifications, duties and responsibilities as provided for a
</s>    |
<s></s>0001| <s>    manager under Sections 3-14-13 through 3-14-15 NMSA 1978]</s> <u>by
</u>    |
<u></u>0002| <u>    ordinance for a professional administrator.  The administrator
</u>    |
<u></u>0003| <u>    shall be supervised by the mayor.  The administrator shall:
</u>    |
<u></u>0004| <u>                   (1)  enforce and carry out all ordinances,
</u>    |
<u></u>0005| <u>    rules and regulations enacted by the governing body;
</u>    |
<u></u>0006| <u>                   (2)  prepare and submit an annual budget;
</u>    |
<u></u>0007| <u>                   (3)  recommend to the mayor qualified persons
</u>    |
<u></u>0008| <u>    to be appointed as employees or officers of the municipality;
</u>    |
<u></u>0009| <u>    and
</u>    |
<u></u>0010| <u>                   (4)  make recommendations to the mayor and the
</u>    |
<u></u>0011| <u>    governing body on all matters concerning the welfare of the
</u>    |
<u></u>0012| <u>    municipality.
</u>    |
<u></u>0013| <u>              B.  The administrator shall have a seat, but no
</u>    |
<u></u>0014| <u>    vote, at every meeting of the governing body.
</u>    |
<u></u>0015| <u>              C.  The administrator shall be appointed by the
</u>    |
<u></u>0016| <u>    mayor with the approval of the governing body.
</u>    |
<u></u>0017| <u>              D.  Unless reappointed, no administrator shall be
</u>    |
<u></u>0018| <u>    employed beyond the day of the organizational meeting required
</u>    |
<u></u>0019| <u>    in Section 3-11-5 NMSA 1978.</u>"
