0012| IMPROVEMENT ACT TO PROVIDE REWARDS TO SCHOOLS THAT PERFORM

0013| HIGHER THAN EXPECTED; MAKING AN APPROPRIATION TO THE INCENTIVES
|
0014| FOR SCHOOL IMPROVEMENT FUND.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 22-13A-1 NMSA 1978 (being Laws 1989,
|
0018| Chapter 137, Section 1) is amended to read:
|
0019| "22-13A-1. SHORT TITLE. [This act] Chapter 22, Article
|
0020| 13A NMSA 1978 may be cited as the "Incentives for School
|
0021| Improvement Act"."
|
0022| Section 2. Section 22-13A-2 NMSA 1978 (being Laws 1989,
|
0023| Chapter 137, Section 2) is amended to read:
|
0024| "22-13A-2. PURPOSE.--The purpose of the Incentives for
|
0025| School Improvement Act is to provide financial incentives to
|
0001| [school districts in order to improve the academic performance
|
0002| and school behavior of students] individual schools that
|
0003| exceed expected academic performance."
|
0004| Section 3. Section 22-13A-4 NMSA 1978 (being Laws 1989,
|
0005| Chapter 137, Section 4) is amended to read:
|
0006| "22-13A-4. PROGRAM CREATED--ADMINISTRATION--PROGRAM
|
0007| APPROVAL.--The "incentives for school improvement program" is
|
0008| created. The program shall be administered by the department.
|
0009| The department shall develop a standardized method to measure
|
0010| the progress of students enrolled in public schools
|
0011| [electing to participate in the program] in school districts
|
0012| throughout the state. The standardized method developed shall
|
0013| be reviewed and approved by the state board."
|
0014| Section 4. Section 22-13A-5 NMSA 1978 (being Laws 1989,
|
0015| Chapter 137, Section 5) is amended to read:
|
0016| "22-13A-5. PROGRAM IMPLEMENTATION--MEASUREMENT CRITERIA.-
|
0017| -
|
0018| A. The department shall develop a formula by which
|
0019| to measure school achievement in the areas of academic
|
0020| performance [and student behavior. This formula shall include
|
0021| a factor which takes into account the number of students at
|
0022| risk of school failure in attendance at a school] with
|
0023| consideration of socioeconomic variables. The product of this
|
0024| formula shall take the form of a composite rating assigned to
|
0025| each school [participating in the program] in every school
|
0001| district.
|
0002| B. Academic performance shall be measured by:
|
0003| (1) nationally standardized test scores;
|
0004| (2) graduation competency scores; and
|
0005| (3) other factors deemed relevant by the
|
0006| department.
|
0007| [C. Student behavior shall be measured by:
|
0008| (1) dropout rates;
|
0009| (2) graduation rates;
|
0010| (3) attendance rates; and
|
0011| (4) other factors deemed relevant by the
|
0012| department.
|
0013| D. The students at risk of school failure factor
|
0014| shall be measured by:
|
0015| (1) the number of bilingual program units
|
0016| received by the school;
|
0017| (2) the number of low-income students as
|
0018| measured by federal poverty guidelines; and
|
0019| (3) other factors deemed relevant by the
|
0020| department]
|
0021| C. The socioeconomic variables shall be measured
|
0022| by:
|
0023| (1) the percentage of student mobility rates;
|
0024| (2) the percentage of limited English-
|
0025| proficient students using criteria established by the federal
|
0001| office of civil rights;
|
0002| (3) the percentage of students eligible for
|
0003| free and reduced-fee lunches; and
|
0004| (4) other factors deemed relevant by the
|
0005| department.
|
0006| [E.] D. Annually, the department shall assign a
|
0007| new composite rating to [all schools electing to participate
|
0008| in the program] each school. The department shall compare
|
0009| the new rating to the previous annual rating. Schools
|
0010| increasing their composite rating shall be ranked in order. The
|
0011| schools evidencing the greatest increase in rating shall re-
|
0012|
|
0013| ceive monetary disbursements from the fund."
|
0014| Section 5. Section 22-13A-6 NMSA 1978 (being Laws 1989,
|
0015| Chapter 137, Section 6) is amended to read:
|
0016| "22-13A-6. FUND CREATED.--
|
0017| A. There is created in the state treasury the
|
0018| "incentives for school improvement fund". The fund shall
|
0019| consist of any state money appropriated to the fund, any
|
0020| federal money allocated to the state for the purposes of
|
0021| [this] the Incentives for School Improvement Act,
|
0022| undistributed annual balances and earnings of the fund and any
|
0023| gifts or bequests made to the fund. The state treasurer shall
|
0024| invest the fund as other state funds are invested. The balance
|
0025| remaining in the fund at the end of the fiscal year shall not
|
0001| revert to the general fund.
|
0002| B. The fund [shall be expended by the
|
0003| superintendent of public instruction] is appropriated to the
|
0004| department for the purpose of implementing and administering
|
0005| the Incentives for School Improvement Act. No more than one-
|
0006| half of one percent of the fund [shall] may be retained by
|
0007| the [state superintendent] department for administrative
|
0008| purposes.
|
0009| C. Money in the fund other than that used for
|
0010| administrative purposes shall be distributed directly to [the
|
0011| New Mexico elementary, middle and secondary] schools
|
0012| evidencing the greatest improvement [based upon their
|
0013| composite rating] as determined by the department.
|
0014| Disbursements shall by made only to that number of schools
|
0015| constituting not more than ten percent of the student
|
0016| membership in the state. Distributions shall be made
|
0017| proportionately to schools that qualify. Money received by a
|
0018| school from the fund shall not be [utilized] used for
|
0019| salaries, [or] salary increases or bonuses. Money shall be
|
0020| [utilized for school improvement purposes] used as
|
0021| determined by the school principal and teachers in cooperation
|
0022| with other school employees and the community."
|
0023| Section 6. APPROPRIATION.--One million three hundred
|
0024| thousand dollars ($1,300,000) is appropriated from the general
|
0025| fund to the incentives for school improvement fund for
|
0001| expenditure in fiscal year 1998 for the purpose of implementing
|
0002| and administering the Incentives for School Improvement Act.
|
0003| Any unexpended or unencumbered balance remaining at the end of
|
0004| fiscal year 1998 shall revert to the general fund.
