ARAGON | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO MUNICIPALITIES; ENACTING SECTIONS OF THE NMSA 1978 | 0012| TO TRANSFER OWNERSHIP OF CERTAIN WATER AND SEWER FACILITIES | 0013| LOCATED BY A MUNICIPALITY HAVING A POPULATION OF OVER TWO | 0014| HUNDRED THOUSAND PERSONS IN THE UNINCORPORATED AREA OF A CLASS | 0015| A COUNTY TO THE COUNTY. | 0016| | 0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0018| Section 1. STATE-FINANCED WATER AND SEWER FACILITIES-- | 0019| OWNERSHIP--CLASS A COUNTIES.--Ownership of water and sewer | 0020| facilities planned, designed, constructed, installed, acquired, | 0021| improved or renovated with funds provided through the issuance | 0022| of severance tax bonds and located in the unincorporated areas | 0023| of a class A county by a municipality in the county and having | 0024| a population of over two hundred thousand shall be transferred | 0025| to the class A county if the county creates, acquires, | 0001| contracts for, initiates or otherwise operates a water and | 0002| sewer utility sufficient to supply water and sewer service to | 0003| its inhabitants using the water and sewer facilities | 0004| transferred to it pursuant to this section. The local | 0005| government division of the department of finance and | 0006| administration shall oversee and administer, with the | 0007| department of environment, severance tax bonds for water and | 0008| sewer facilities to be located in the unincorporated areas of | 0009| class A counties by municipalities having a population of over | 0010| two hundred thousand to ensure that the provisions of this | 0011| section are met; and shall maintain records sufficient to | 0012| ensure that the transfer of water and sewer facilities to the | 0013| class A county are made in accordance with this section. The | 0014| transfer described in this section is ineffective if the | 0015| unincorporated area of the county in which the water and sewer | 0016| facilities financed by severance tax bonds are located is | 0017| annexed by the municipality locating the facilities there. | 0018| Section 2. CLASS A COUNTY WATER AND SEWER FACILITIES TASK | 0019| FORCE.--If a class A county, in which a municipality is located | 0020| having a population of over two hundred thousand, creates, | 0021| acquires, contracts for, initiates or otherwise operates a | 0022| water and sewer utility to provide service to its inhabitants | 0023| in the unincorporated area of the county, a joint county- | 0024| municipal water and sewer facilities task force shall be | 0025| established to determine the schedule procedure and terms of | 0001| the transfer of the water and sewer facilities financed by | 0002| severance tax bonds and located in the unincorporated areas of | 0003| the class A county by the municipality. The task force shall | 0004| be comprised of three members, one each appointed by the | 0005| governing bodies of the county and the municipality, and the | 0006| third appointed by the other two. If the two members appointed | 0007| by the governing bodies cannot reach agreement as to the | 0008| appointment of the third member of the task force, the third | 0009| member shall be appointed by the chief judge of the district | 0010| court located in the county.
