0011| PERMITTING MUNICIPALITIES TO ASSESS DEVELOPMENT IMPACT FEES
|
0012| OUTSIDE THE MUNICIPAL BOUNDARIES UNDER CERTAIN CIRCUMSTANCES.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0015| Section 1. Section 5-8-3 NMSA 1978 (being Laws 1993,
|
0016| Chapter 122, Section 3) is amended to read:
|
0017| "5-8-3. AUTHORIZATION OF FEE.--
|
0018| A. Unless otherwise specifically authorized by the
|
0019| Development Fees Act, no municipality or county may enact or
|
0020| impose an impact fee.
|
0021| B. If it complies with the Development Fees Act, a
|
0022| municipality or county may enact or impose impact fees on land
|
0023| within its respective corporate boundaries.
|
0024| C. A municipality and county may enter into a joint
|
0025| powers agreement to provide capital improvements within an area
|
0001| subject to both county and municipal platting and subdivision
|
0002| jurisdiction or extraterritorial jurisdiction and may charge an
|
0003| impact fee under the agreement, but if an impact fee is charged
|
0004| in that area, the municipality and county shall comply with the
|
0005| Development Fees Act.
|
0006| D. If a municipality wishes to provide capital
|
0007| improvements within an area outside the municipality that is
|
0008| subject to both county and municipal platting and subdivision
|
0009| jurisdiction or extraterritorial jurisdiction, and the county
|
0010| chooses not to enter into a joint powers agreement, the
|
0011| municipality may proceed with the capital improvements and may
|
0012| charge an impact fee in compliance with the Development Fees
|
0013| Act."
