0011| RELATING TO MOTOR VEHICLES; AMENDING THE CRIMINAL PENALTY FOR

0012| RECEIVING OR TRANSFERRING A STOLEN MOTOR VEHICLE; AMENDING A

0013| SECTION OF THE MOTOR VEHICLE CODE.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0016| Section 1. Section 66-3-505 NMSA 1978 (being Laws 1978,
|
0017| Chapter 35, Section 92) is amended to read:
|
0018| "66-3-505. RECEIVING OR TRANSFERRING STOLEN VEHICLES OR
|
0019| MOTOR VEHICLES.--Any person who, with intent to procure or pass
|
0020| title to a vehicle or motor vehicle [which] that he knows
|
0021| or has reason to believe has been stolen or unlawfully taken,
|
0022| receives or transfers possession of the [same] vehicle or
|
0023| motor vehicle from or to another or who has in his possession
|
0024| any vehicle [which] that he knows or has reason to believe
|
0025| has been stolen or unlawfully taken and who is not an officer
|
0001| of the law engaged at the time in the performance of his duty
|
0002| as such officer is guilty of a fourth degree felony and upon
|
0003| conviction shall be sentenced to imprisonment for [not less
|
than one nor more than five years or to] a definite term not
|
0005| to exceed two years or the payment of a fine of not more than
|
0006| five thousand dollars ($5,000) or [to] both [such
|
imprisonment and fine in the discretion of the judge]."
|
0008| Section 2. EFFECTIVE DATE.--The effective date of the
|
0009| provisions of this act is July 1, 1997.
