0011| RELATING TO FLOOD CONTROL AND DRAINAGE; AUTHORIZING THE

0012| ALBUQUERQUE METROPOLITAN ARROYO FLOOD CONTROL AUTHORITY TO

0013| CREATE AND ADMINISTER IMPROVEMENT DISTRICTS LIMITED TO FLOOD

0014| CONTROL AND DRAINAGE PURPOSES; AMENDING A SECTION OF THE NMSA

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0018| Section 1. Section 72-16-20 NMSA 1978 (being Laws 1963,
|
0019| Chapter 311, Section 20) is amended to read:
|
0020| "72-16-20. IMPLEMENTING POWERS.--The board may:
|
0021| A. acquire, improve, equip, maintain and operate
|
0022| any project or facility for the control of flood and storm
|
0023| waters of the authority and the flood and storm waters of
|
0024| streams [which] that have their sources outside of the
|
0025| authority but which streams and the flood waters thereof flow
|
0001| into the authority;
|
0002| B. protect from such floods or storm waters the
|
0003| water courses, watersheds, public highways, life and property
|
0004| in the authority;
|
0005| C. exercise the right of eminent domain, either
|
0006| within or without the authority, in the manner provided by law
|
0007| for the condemnation of private property for public use; and
|
0008| D. as to flood control and drainage projects only,
|
0009| exercise those powers granted to counties in the County
|
0010| Improvement District Act."

0011| Section 2. EFFECTIVE DATE.--The effective date of the
|
0012| provisions of this act is July 1, 1997.
