0011| RELATING TO HEALTH; ALLOWING USE OF THE COUNTY INDIGENT

0012| HOSPITAL CLAIMS FUND FOR RETENTION OF GENERAL PRACTITIONERS IN

0013| CERTAIN CIRCUMSTANCES; AMENDING A SECTION OF THE NMSA 1978.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0016| Section 1. Section 27-5-7.1 NMSA 1978 (being Laws 1993,
|
0017| Chapter 321, Section 16) is amended to read:
|
0018| "27-5-7.1. COUNTY INDIGENT HOSPITAL CLAIMS FUND--
|
0019| AUTHORIZED USES OF THE FUND.--
|
0020| A. The fund shall be used:
|
0021| (1) to meet the county's contribution for
|
0022| support of sole community provider payments as calculated by
|
0023| the department for that county; and
|
0024| (2) to pay all claims that have been approved
|
0025| by the board that are not matched with federal funds under the
|
0001| state medicaid program.
|
0002| B. The fund may be used to meet the county's
|
0003| obligation under Section 27-10-4 NMSA 1978.
|
0004| [C. Until June 30, 1996, the cash reserves from
|
0005| the fund may be used to meet the county's obligation under
|
0006| Section 27-10-4 NMSA 1978.]
|
0007| C. In a county with a critical shortage of general
|
0008| practitioners, the fund may be used to reimburse a hospital or
|
0009| health care provider for payments made to ensure the continued
|
0010| availability of a general practitioner, residing and working in
|
0011| the county, to provide medical services to the indigent of the
|
0012| county."
