0011| RELATING TO PUBLIC SCHOOLS; AMENDING SECTION 61-14B-8 NMSA 1978

0012| (BEING LAWS 1996, CHAPTER 57, SECTION 8).
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 61-14B-8 NMSA 1978 (being Laws 1996,
|
0016| Chapter 57, Section 8) is amended to read:
|
0017| "61-14B-8. EXEMPTIONS.--
|
0018| A. Nothing in the Speech Language Pathology,
|
0019| Audiology and Hearing Aid Dispensing Practices Act shall be
|
0020| construed to prevent qualified members of other recognized
|
0021| professions that are licensed, certified or registered under
|
0022| New Mexico law or regulation from rendering services within the
|
0023| scope of their license, certificate or registration, provided
|
0024| they do not represent themselves as holding a license in speech
|
0025| language pathology, audiology or hearing aid dispensing.
|
0001| B. Any person not meeting the requirements for
|
0002| licensure as a speech language pathologist or audiologist under
|
0003| the provisions of the Speech Language Pathology, Audiology and
|
0004| Hearing Aid Dispensing Practices Act may practice as a speech
|
0005| pathologist or audiologist [until July 1, 1997] if:
|
0006| (1) he is employed as a speech pathologist or
|
0007| audiologist on a waiver license issued by the state department
|
0008| of public education [prior to the effective date of that
|
0009| act]; and
|
0010| (2) he is actively seeking the educational
|
0011| requirements for licensure under that act.
|
0012| C. Nothing in the Speech Language Pathology,
|
0013| Audiology and Hearing Aid Dispensing Practices Act prevents
|
0014| qualified members of other recognized professional groups, such
|
0015| as licensed physicians, dentists or teachers of the deaf, from
|
0016| doing appropriate work in the area of communication disorders
|
0017| consistent with the standards and ethics of their respective
|
0018| professions.
|
0019| D. Nothing in the Speech Language Pathology,
|
0020| Audiology and Hearing Aid Dispensing Practices Act restricts
|
0021| the activities and services of a speech language pathology or
|
0022| audiology graduate student at an accredited or approved college
|
0023| or university or an approved clinical training facility;
|
0024| provided that these activities and services constitute part of
|
0025| his supervised course of study and that he is designated as a
|
0001| speech language pathology or audiology graduate student or
|
0002| other title clearly indicating the training status appropriate
|
0003| to his level of training."

|

0005| those activities solely within the confines of or under the

0006| jurisdiction of the state board of education in which they are
|
0007| employed and do not offer to render speech-language pathology or
|
0008| audiology services to the public for a fee, monetary or
|
0009| otherwise, paid to the person, institution or agency.".
