0011| RELATING TO ELECTRONIC INFORMATION; ENACTING THE ELECTRONIC
|
0012| ACCESS ACT.
|

|
0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. SHORT TITLE.--This act may be cited as the
|
0016| "Electronic Access Act".
|
0017| Section 2. FINDINGS AND PURPOSE.--The legislature finds
|
0018| that it is now feasible in this electronic age to distribute
|
0019| public information, including proposed and enacted state laws,
|
0020| regulations, rulings and reported judicial decisions, by way of
|
0021| electronic medium, including the internet and its branches, in
|
0022| order to better inform the public of state laws and judicial
|
0023| decisions and to provide easy and free access to those
|
0024| documents. The legislature declares that the purpose of the
|
0025| Electronic Access Act is to make that information available to
|
0001| the public in a timely manner and at the least possible cost.
|
0002| Section 3. DEFINITION.--As used in the Electronic Access
|
0003| Act, "electronic form" includes publication on the worldwide
|
0004| web and other branches of the internet and includes providing
|
0005| members of the public, upon request, the information described
|
0006| in Section 4 of that act in electronic formats, including
|
0007| computer disks.
|
0008| Section 4. INFORMATION PROVIDED.--The legislative council
|
0009| service and the New Mexico compilation commission shall, on or
|
0010| before July 1, 1997, make all of the following information and
|
0011| documents available to the public in electronic form:
|
0012| A. the legislative calendar, the schedule of
|
0013| legislative committee hearings, a list of matters pending on
|
0014| the floors of both houses of the legislature and a list of the
|
0015| committees of the legislature and their members;
|
0016| B. the full text of each bill introduced in each
|
0017| current legislative session, including all amendments and
|
0018| substitutions;
|
0019| C. the history of each bill introduced and amended
|
0020| in each current legislative session;
|
0021| D. a means by which the public may easily search
|
0022| the data base of all bills introduced in each legislative
|
0023| session by subject, title or sponsor;
|
0024| E. the status of each bill introduced and amended
|
0025| in each current legislative session;
|
0001| F. all vote information concerning a bill
|
0002| introduced in each current legislative session;
|
0003| G. the current NMSA 1978;
|
0004| H. the constitution of New Mexico;
|
0005| I. all reported judicial decisions issued by New
|
0006| Mexico courts;
|
0007| J. the full text of the New Mexico register;
|
0008| K. the full text of the New Mexico Administrative
|
0009| Code;
|
0010| L. the full text of any rule filed by any state
|
0011| agency with the records center; and
|
0012| M. any other information or documents copyrighted
|
0013| by the state relating to the information described in this
|
0014| section. Section 5. PUBLIC ACCESS.--
|
0015| A. The information and documents described in
|
0016| Section 4 of the Electronic Access Act shall be made available
|
0017| to the public by means of access by way of the public computer
|
0018| network commonly referred to as the internet. The information
|
0019| shall also be made available in one or more formats, including
|
0020| computer disks and bulletin boards, and by one or more means in
|
0021| order to provide the greatest feasible access by the public to
|
0022| the information described in Section 4 of that act. Any person
|
0023| who accesses that information may access all or any part of the
|
0024| information. All information and documents described shall be
|
0025| kept current and updated in the shortest feasible time after
|
0001| the information is obtained by either the legislative council
|
0002| service or the New Mexico compilation commission.
|
0003| B. Personal information concerning a person who
|
0004| accesses the information may be maintained only for the purpose
|
0005| of providing service to that person and shall not be sold,
|
0006| disclosed or otherwise disseminated.
|
0007| C. No fee or other charge may be imposed upon any
|
0008| member of the public for accessing or receiving the information
|
0009| or documents in the forms described in Section 4 of the
|
0010| Electronic Access Act. However, the legislative council
|
0011| service or the New Mexico compilation commission may charge a
|
0012| reasonable fee for providing the information described on
|
0013| computer disk, not to exceed one dollar ($1.00) per disk. The
|
0014| legislative council service or the New Mexico compilation
|
0015| commission may also allow members of the public to provide
|
0016| their own computer disks for the purpose of receiving the
|
0017| information described, subject to those safeguards as the
|
0018| agencies deem necessary to protect the integrity of the system
|
0019| or data.
|
0020| D. The electronic access provided through the
|
0021| internet shall be in addition to other electronic distribution
|
0022| of the information described.
|
0023| E. No action taken pursuant to the Electronic
|
0024| Access Act shall alter or relinquish any copyright or other
|
0025| proprietary interest or entitlement of the state relating to
|
0001| any of the information made available pursuant to that act.
