JENNINGS | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO HEALTH; PROVIDING FOR DEVELOPMENT AND | 0012| IMPLEMENTATION OF A PLAN FOR GROWTH OF INTERMEDIATE CARE | 0013| FACILITIES FOR THE MENTALLY RETARDED. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. Section 24-1-5.3 NMSA 1978 (being Laws 1990, | 0017| Chapter 97, Section 1, as amended) is amended to read: | 0018| "24-1-5.3. INTERMEDIATE CARE FACILITIES FOR THE MENTALLY | 0019| RETARDED--LICENSURE MORATORIUM.-- | 0020| A. The department shall not issue a license to any | 0021| new intermediate care facility for the mentally retarded nor | 0022| shall the department issue a license for an increase over the | 0023| bed capacity that existed on January 1, 1993 in an existing | 0024| facility. No such facility shall apply for licensure except as | 0025| provided in Subsection B of this section. | 0001| B. Except as provided in Subsection C of this | 0002| section for transfers, the department may accept applications | 0003| for and issue licenses to intermediate care facilities for the | 0004| mentally retarded on and after the earliest of the following | 0005| dates: | 0006| (1) ~~[July 1, 1997]~~ January 1, 1999, | 0007| provided that the secretary of human services certifies to the | 0008| secretary of health that the human services department and the | 0009| department of health have approved and begun implementation of | 0010| a plan to control the growth of intermediate care facilities | 0011| for the mentally retarded and to establish the future role of | 0012| intermediate care facilities for the mentally retarded in the | 0013| developmental disabilities service system; ~~[or]~~ | 0014| (2) July 1, 1999 if it is necessary to have | 0015| legislation enacted to facilitate the implementation of the | 0016| plan; or | 0017| ~~[(2)]~~ (3) the date the secretary of health | 0018| certifies to the department of finance and administration that | 0019| an emergency exists that threatens the health and safety of | 0020| persons with developmental disabilities, provided that licenses | 0021| granted under this paragraph do not exceed the total statewide | 0022| bed capacity that existed on January 1, 1993. | 0023| C. Upon application, the department may transfer | 0024| no more than eighty beds from currently licensed intermediate | 0025| care facilities for the mentally retarded to other licensed | 0001| intermediate care facilities for the mentally retarded; | 0002| provided those facilities: | 0003| (1) are licensed to provide sufficient beds | 0004| and care for no more than four mentally retarded persons; | 0005| (2) include fiscal, geographic, service and | 0006| access criteria necessary to provide for the needs of persons | 0007| in need of such facilities; | 0008| (3) are in accordance with the freedom of | 0009| choice provisions of Title XIX of the Social Security Act; and | 0010| (4) are located no closer than one hundred | 0011| fifty feet from an existing intermediate care facility for the | 0012| mentally retarded, developmentally disabled or a nursing home. | 0013| ~~[C.]~~ D. As used in this section, "intermediate | 0014| care facility for the mentally retarded" means any intermediate | 0015| care facility eligible for certification as an intermediate | 0016| care facility for the mentally retarded." | 0017| Section 2. [NEW MATERIAL] PLAN OF GROWTH-- | 0018| REQUIREMENTS--REPORTING.--No later than July 1, 1999 the human | 0019| services department and the department of health shall develop | 0020| and implement a plan to control growth of intermediate care | 0021| facilities for the mentally retarded and clarify the role of | 0022| intermediate care facilities for the mentally retarded in the | 0023| developmental disabilities care system. The plan shall include | 0024| fiscal, geographical, service and access criteria necessary to | 0025| provide for the needs of individuals in need of such facilities | 0001| and shall be in accordance with the freedom of choice | 0002| provisions of Title XIX of the Social Security Act.
