0011|     RELATING TO SPECIAL DISTRICTS; REQUIRING A PERSON TO PHYSICALLY

0012|     RESIDE WITHIN A SOIL AND WATER CONSERVATION DISTRICT TO VOTE IN

0013|     A DISTRICT ELECTION; AMENDING A SECTION OF THE SOIL AND WATER
    |
0014|     CONSERVATION DISTRICT ACT.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  Section 73-21-14 NMSA 1978 (being Laws 1943,
    |
0018|     Chapter 80, Section 13, as amended) is amended to read:
    |
0019|          "73-21-14.  ELECTIONS.--
    |
0020|               A.  In any district, except a district created
    |
0021|     pursuant to a petition signed by the chairman of the board of
    |
0022|     county commissioners of a county, on the second Tuesday of
    |
0023|     January in the second calendar year after the organization of
    |
0024|     the district and on the second Tuesday of January every second
    |
0025|     year thereafter, there shall be elected by the <s>[taxpaying]</s>
    |
0001|     electors <s>[of]</s> <u>who physically reside within</u> the district one
    |
0002|     member of the board to serve for a term of six years, except
    |
0003|     that if the district elects to adopt four-year terms, the
    |
0004|     member shall serve for a term of four years.
    |
0005|               B.  In any district created pursuant to a petition
    |
0006|     signed by the chairman of the board of county commissioners of
    |
0007|     a county, one year after the organization of the district and
    |
0008|     every second year thereafter, there shall be elected by <s>[the
</s>    |
<s></s>0009| <s>    taxpaying]</s> electors <s>[of]</s> <u>who physically reside within</u> the
    |
0010|     district at least two, but no more than three, members of the
    |
0011|     board to serve for a term of two years.
    |
0012|               C.  Not later than thirty days before any election
    |
0013|     pursuant to Subsections A or B of this section, nominations may
    |
0014|     be filed with the secretary of the board and, if a nominee does
    |
0015|     not withdraw his name before the first publication of the
    |
0016|     notice of election, his name shall be placed on the ballot. 
    |
0017|     The board shall provide for holding such election and shall
    |
0018|     appoint judges to conduct it.  The secretary of the district
    |
0019|     shall give notice of election by publication and shall arrange
    |
0020|     such other details in connection therewith as the board may
    |
0021|     direct.  The returns of the election shall be certified to and
    |
0022|     shall be canvassed and declared by the board.  The candidate
    |
0023|     receiving the most votes shall be elected.  Any new member of
    |
0024|     the board shall qualify in the same manner as members of the
    |
0025|     first board qualify."
