0013| FROM THE MEDICAID MANAGED CARE SYSTEM.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 27-2-1 NMSA 1978 (being Laws 1973,
|
0017| Chapter 376, Section 1) is amended to read:
|
0018| "27-2-1. SHORT TITLE.--Sections [1 through 20 of this
|
0019| act and Sections 13-1-9, 13-1-10, 13-1-12, 13-1-13, 13-1-17,
|
0020| 13-1-18, 13-1-18.1, 13-1-19, 13-1-20, 13-1-20.1, 13-1-21,
|
0021| 13-1-22, 13-1-27, 13-1-27.2, 13-1-27.3, 13-1-27.4, 13-1-28,
|
0022| 13-1-28.6, 13-1-29, 13-1-30, 13-1-34, 13-1-35, 13-1-37, 13-1-
|
0023| 39, 13-1-40, 13-1-41 and 13-1-42 NMSA 1953] 27-2-1 through
|
0024| 27-2-36 NMSA 1978 may be cited as the "Public Assistance
|
0025| Act"."

0001| Section 2. Section 27-2-12.6 NMSA 1978 (being Laws 1994,
|
0002| Chapter 62, Section 22) is amended to read:
|
0003| "27-2-12.6. MEDICAID PAYMENTS--MANAGED CARE.--
|
0004| A. The department shall provide for a statewide
|
0005| managed care system to provide cost-efficient, preventive,
|
0006| primary and acute care for medicaid recipients by July 1, 1995.
|
0007| B. The managed care system shall ensure:
|
0008| (1) access to medically necessary services,
|
0009| particularly for medicaid recipients with chronic health
|
0010| problems;
|
0011| (2) to the extent practicable, maintenance of
|
0012| the rural primary care delivery infrastructure;
|
0013| (3) that the department's approach is
|
0014| consistent with national and state health care reform
|
0015| principles; and
|
0016| (4) to the maximum extent possible, that
|
0017| medicaid-eligible individuals are not identified as such except
|
0018| as necessary for billing purposes.
|
0019| C. The department may exclude nursing homes,
|
0020| intermediate care facilities for the mentally retarded,
|
0021| medicaid in-home and community-based waiver services and
|
0022| residential and community-based mental health services for
|
0023| children with serious emotional disorders from the provisions
|
0024| of this section.
|
0025| D. The department shall exclude pharmaceutical
|
0001| services and supplies from the provisions of this section."
