0011| RELATING TO PUBLIC EMPLOYEE BARGAINING; CLARIFYING THAT CERTAIN
|
0012| STATE EDUCATIONAL INSTITUTIONS MAY CREATE LOCAL BOARDS;
|
0013| AMENDING A SECTION OF THE PUBLIC EMPLOYEE BARGAINING ACT.
|

|
0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 10-7D-4 NMSA 1978 (being Laws 1992,
|
0017| Chapter 9, Section 4) is amended to read:
|
0018| "10-7D-4. DEFINITIONS.--As used in the Public Employee
|
0019| Bargaining Act:
|
0020| A. "appropriate bargaining unit" means a group of
|
0021| public employees designated by the board or local board for the
|
0022| purpose of collective bargaining;
|
0023| B. "appropriate governing body" means the
|
0024| policymaking body or individual representing a public employer
|
0025| as defined in Section [7 of the Public Employee Bargaining
|
0001| Act] 10-7D-7 NMSA 1978;
|
0002| C. "board" means the public employee labor
|
0003| relations board;
|
0004| D. "certification" means the designation by the
|
0005| board or local board of a labor organization as the exclusive
|
0006| representative for all public employees in an appropriate
|
0007| bargaining unit;
|
0008| E. "collective bargaining" means the act of
|
0009| negotiating between a public employer and an exclusive
|
0010| representative for the purpose of entering into a written
|
0011| agreement regarding wages, hours and other terms and conditions
|
0012| of employment;
|
0013| F. "confidential employee" means a person who
|
0014| assists and acts in a confidential capacity with respect to a
|
0015| person who formulates, determines and effectuates management
|
0016| policies;
|
0017| G. "exclusive representative" means a labor
|
0018| organization that, as a result of certification, has the right
|
0019| to represent all public employees in an appropriate bargaining
|
0020| unit for the purposes of collective bargaining;
|
0021| H. "factfinding" means the procedure following
|
0022| mediation whereby the parties involved in an impasse submit
|
0023| their differences to a third party for an advisory
|
0024| recommendation;
|
0025| I. "impasse" means failure of a public employer and
|
0001| an exclusive representative, after good-faith bargaining, to
|
0002| reach agreement in the course of negotiating a collective
|
0003| bargaining agreement;
|
0004| J. "labor organization" means any employee
|
0005| organization, one of whose purposes is the representation of
|
0006| public employees in collective bargaining and in otherwise
|
0007| meeting, consulting and conferring with employers on matters
|
0008| pertaining to employment relations;
|
0009| K. "local board" means a local labor relations
|
0010| board established by a public employer, other than the state,
|
0011| through ordinance, resolution or charter amendment;
|
0012| L. "lockout" means an act by a public employer to
|
0013| prevent its employees from going to work and undertaken for
|
0014| the purpose of resisting the demands of the employees'
|
0015| exclusive representative or for the purpose of gaining a
|
0016| concession from the exclusive representative;
|
0017| M. "management employee" means an employee who is
|
0018| engaged primarily in executive and management functions and is
|
0019| charged with the responsibility of developing, administering or
|
0020| effectuating management policies. An employee shall not be
|
0021| deemed a management employee solely because the employee
|
0022| participates in cooperative decision-making programs on an
|
0023| occasional basis;
|
0024| N. "mediation" means assistance by an impartial
|
0025| third party to resolve an impasse between a public employer and
|
0001| an exclusive representative regarding employment relations
|
0002| through interpretation, suggestion and advice;
|
0003| O. "professional employee" means an employee whose
|
0004| work is predominantly intellectual and varied in character and
|
0005| whose work involves the consistent exercise of discretion and
|
0006| judgment in its performance and requires knowledge of an
|
0007| advanced nature in a field of learning customarily requiring
|
0008| specialized study at an institution of higher education or its
|
0009| equivalent. The work of a professional employee is of such
|
0010| character that the output or result accomplished cannot be
|
0011| standardized in relation to a given period of time;
|
0012| P. "public employee" means a regular,
|
0013| nonprobationary employee of a public employer; provided that in
|
0014| the public schools, "public employee" shall also include any
|
0015| regular probationary employee;
|
0016| Q. "public employer" means the state or any
|
0017| political subdivision thereof, including municipalities having
|
0018| adopted home rule charters, and does not include any government
|
0019| of a tribe or pueblo. State educational institutions, as
|
0020| provided in Article 12, Section 11 of the constitution of New
|
0021| Mexico, shall be considered public employers other than the
|
0022| state;
|
0023| R. "strike" means a public employee's refusal, in
|
0024| concerted action with other public employees, to report for
|
0025| duty or his willful absence in whole or in part from the full,
|
0001| faithful and proper performance of the duties of employment for
|
0002| the purpose of inducing, influencing or coercing a change in
|
0003| the conditions, compensation, rights, privileges or obligations
|
0004| of public employment; and
|
0005| S. "supervisor" means an employee who devotes a
|
0006| substantial amount of work time to supervisory duties, who
|
0007| customarily and regularly directs the work of two or more other
|
0008| employees and who has the authority in the interest of the
|
0009| employer to hire, promote or discipline other employees or to
|
0010| recommend such actions effectively, but does not include
|
0011| individuals who perform merely routine, incidental or clerical
|
0012| duties or who occasionally assume supervisory or directory
|
0013| roles or whose duties are substantially similar to those of
|
0014| their subordinates and does not include lead employees or
|
0015| employees who participate in peer review or occasional employee
|
0016| evaluation programs."
