0011| RELATING TO PIPELINES; ESTABLISHING A ONE-CALL NOTIFICATION
|
0012| SYSTEM FOR UNDERGROUND EXCAVATIONS; AMENDING AND ENACTING
|
0013| SECTIONS OF THE NMSA 1978.
|

|
0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. A new section of Chapter 62, Article 14 NMSA
|
0017| 1978 is enacted to read:
|
0018| "[NEW MATERIAL] PIPELINE ONE-CALL NOTIFICATION SYSTEM.--
|
0019| A. Every owner or operator of a pipeline facility
|
0020| shall be a member of a one-call notification system. A one-
|
0021| call notification system may be for a region of the state or
|
0022| statewide in scope, unless federal law provides otherwise.
|
0023| B. Each one-call notification system shall be
|
0024| operated by:
|
0025| (1) an owner or operator of pipeline
|
0001| facilities;
|
0002| (2) a private contractor;
|
0003| (3) a state or local government agency; or
|
0004| (4) a person who is otherwise eligible under
|
0005| state law to operate a one-call notification system.
|
0006| C. If the one-call notification system is operated
|
0007| by owners or operators of pipeline facilities, it shall be
|
0008| established as a nonprofit entity governed by a board of
|
0009| directors that shall establish the operating processes,
|
0010| procedures and technology needed for a one-call notification
|
0011| system. The board shall further establish a procedure or
|
0012| formula to determine the equitable share of each member for the
|
0013| costs of the one-call notification system. The board may
|
0014| include representatives of excavators or other persons deemed
|
0015| eligible to participate in the system who are not owners or
|
0016| operators.
|
0017| D. Excavators shall give advance notice to the one-
|
0018| call notification system operating in the intended excavation
|
0019| area and provide information established by rule and regulation
|
0020| of the commission, except when excavations are by or for a
|
0021| person that:
|
0022| (1) owns or leases or owns a mineral
|
0023| leasehold interest in the real property on which the excavation
|
0024| occurs; and
|
0025| (2) operates all underground facilities
|
0001| located in the intended excavation area.
|
0002| E. The one-call notification system shall promptly
|
0003| transmit excavation notice information to owners or operators
|
0004| of pipeline facilities in the intended excavation area.
|
0005| F. After receiving advance notice, owners and
|
0006| operators of pipeline facilities shall locate and mark their
|
0007| pipeline facilities in the intended excavation area.
|
0008| G. The one-call notification system shall provide a
|
0009| toll-free telephone number or another comparable and reliable
|
0010| means of communication to receive advance notice of excavation.
|
0011| Means of communication to distribute excavation notice to
|
0012| owners or operators of pipeline facilities shall be reliable
|
0013| and capable of coordination with one-call notification systems
|
0014| operating in other regions of the state.
|
0015| H. Operators of one-call notification systems shall
|
0016| notify the commission of its members and the name and telephone
|
0017| number of the contact person for each member.
|
0018| I. One-call notification systems and owners and
|
0019| operators of pipeline facilities shall promote public awareness
|
0020| of the availability and operation of one-call notification
|
0021| systems and work with state and local governmental agencies
|
0022| charged with issuing excavation permits to provide information
|
0023| concerning and promote awareness by excavators of one-call
|
0024| notification systems."
|
0025| Section 2. A new section of Chapter 62, Article 14 NMSA
|
0001| 1978 is enacted to read:
|
0002| "[NEW MATERIAL] ENFORCEMENT.--If any person excavates
|
0003| or intends to excavate in violation of Chapter 62, Article 14
|
0004| NMSA 1978, the commission or any interested or affected owner
|
0005| or operator of an underground facility may file, in the
|
0006| district court of the county in which the excavation is
|
0007| occurring or intended, an action seeking to enjoin the
|
0008| excavation."
|
0009| Section 3. A new section of Chapter 62, Article 14 NMSA
|
0010| 1978 is enacted to read:
|
0011| "[NEW MATERIAL] RULE-MAKING.--The commission shall
|
0012| promulgate rules and regulations to implement the provisions of
|
0013| Chapter 62, Article 14 NMSA 1978."
|
0014| Section 4. Section 62-14-2 NMSA 1978 (being Laws 1973,
|
0015| Chapter 252, Section 2, as amended) is amended to read:
|
0016| "62-14-2. DEFINITIONS.--For purposes of Chapter 62,
|
0017| Article 14 NMSA 1978:
|
0018| A. "blasting" means the use of an explosive to
|
0019| excavate;
|
0020| B. "excavate" means the movement or removal of
|
0021| earth using mechanical excavating equipment or blasting and
|
0022| includes augering, backfilling, digging, ditching, drilling,
|
0023| grading, plowing in, pulling in, ripping, scraping, trenching
|
0024| and [tunnelling] tunneling;
|
0025| C. "mechanical excavating equipment" means all
|
0001| equipment powered by any motor, engine or hydraulic or
|
0002| pneumatic device used for excavating and includes trenchers,
|
0003| bulldozers, backhoes, power shovels, scrapers, draglines, clam
|
0004| shells, augers, drills, cable and pipe plows or other plowing-
|
0005| in or pulling-in equipment;
|
0006| D. "one-call notification system" means a
|
0007| communication system in which an operation center provides
|
0008| telephone services or other reliable means of communication for
|
0009| the purpose of receiving excavation notice information and
|
0010| distributing that information to owners and operators of
|
0011| pipeline facilities;
|
0012| [D.] E. "pipeline" means a pipeline or system
|
0013| of pipelines and appurtenances for the transportation or
|
0014| movement of any oil or gas, [mixture of gases or petroleum
|
0015| products suitable for domestic or industrial fuel] oil or gas
|
0016| products and byproducts, but does not include:
|
0017| (1) gas distribution systems; or
|
0018| (2) gathering lines or systems operated
|
0019| exclusively for the gathering of oil or gas, oil and gas
|
0020| products and their byproducts in any field or area, lines or
|
0021| systems constituting a part of any tank farm, plant facilities
|
0022| of any processing plant or underground storage projects, unless
|
0023| it is located:
|
0024| (a) within a municipality; or
|
0025| (b) in the boundaries of an established
|
0001| easement or right of way;
|
0002| [E.] F. "underground utility line" means an
|
0003| underground conduit or cable, including fiber optics, piping
|
0004| and related facilities for transportation and delivery of
|
0005| electricity, telephonic or telegraphic communications or water
|
0006| or distribution of gas;
|
0007| [F.] G. "cable television lines and related
|
0008| facilities" means the facilities of any cable television system
|
0009| or closed-circuit coaxial cable communications system or other
|
0010| similar transmission service used in connection with any cable
|
0011| television system or other similar closed-circuit coaxial cable
|
0012| communications system;
|
0013| [G.] H. "underground facilities" means any
|
0014| tangible property described in Subsections [D] E through
|
0015| [F] G of this section [which] that is underground and
|
0016| does not include residential sprinklers or low-voltage
|
0017| lighting;
|
0018| [H.] I. "person" means the legal
|
0019| representative of or any individual, partnership, corporation,
|
0020| joint venture, state, subdivision or instrumentality of the
|
0021| state or an
|
0022| association [or any legal representative thereof];
|
0023| [I.] J. "means of location" means a mark such
|
0024| as a stake in earthen areas or a paint mark in paved areas
|
0025| [which] that is conspicuous in nature [which] and that
|
0001| is designed to last at least five days if not disturbed;
|
0002| [and]
|
0003| [J.] K. ["reasonable advance notice"]
|
0004| "advance notice" means two working days; and
|
0005| L. "commission" means the state corporation
|
0006| commission or its successor agency."
|
0007| Section 5. Section 62-14-8 NMSA 1978 (being Laws 1973,
|
0008| Chapter 252, Section 8, as amended) is amended to read:
|
0009| "62-14-8. PENALTIES.--In addition to any other liability
|
0010| imposed by law, any person who [willfully] negligently
|
0011| fails to comply with Chapter 62, Article 14 NMSA 1978 and whose
|
0012| failure proximately contributes to the damage of any pipeline
|
0013| or underground utility line shall be subject to a civil penalty
|
0014| not to exceed five hundred dollars ($500) for each offense.
|
0015| All actions to recover the penalties provided for in this
|
0016| section shall be brought by either the attorney general or the
|
0017| appropriate district attorney upon complaint of the [state
|
0018| corporation] commission, the New Mexico public utility
|
0019| commission or the construction industries division of the
|
0020| regulation and licensing department. All such actions shall be
|
0021| brought in the district court in and for the county in which
|
0022| the cause, or some part [thereof] of the cause, arose or in
|
0023| which the person complained of has [their] his principal
|
0024| place of business or residence. All penalties recovered in any
|
0025| such action shall be paid into the state general fund."
|
0001| Section 6. EFFECTIVE DATE.--The effective date of the
|
0002| provisions of this act is October 1, 1997.
